Ok well i've been talking to you folk on here and googling and I really don't know what to believe.

If I go to the US on a tourist visa (Iam australian) can I marry my US citizen boyfriend and return home and file for a spouse visa? Is this considered fraud?????

I've heard that it is and I've heard that it isn't. I do intend on returning home but then filing for Spouse visa...

How long will it take AFTER the marriage for a spouse visa to go through?

How long does it take for a k1 visa to go through if we decide not to marry on the tourist visa?

Which is better? I really don't want to be done for fraud.

Marrying in the US and returning home and filing CR-1 is fine! Not fraud!

The CR-1 spousal visa takes 7-10 months approximately.

The K-1 fiance visa takes 6-9 approximately.

The CR-1 is cheaper and you enter the US and are a legal permanent resident.

With the K-1 you have to marry within 90 days of entering the US after using the visa and then adjust your status.

No one can tel you which option is best for you. There are advocates for both! However there is a comparison chart in the guides above to help you choose.

Marrying in the US and returning is fine. The returning part must happen however

Read the guides and see what visa is best for you. You need to figure out what is most important to you. Some do not want to be separated after marriage so they go for the K-1. Some, like myself, needed to be able to work and travel once I entered the US so we went for the spuosal visa. Cost was also a factor for us, the Cr-1 significantly cheaper, but that doesn't matter to some

It all depends on what is the best choice for you.

We went with K1 because we decided we'd rather be apart during our engagement than right after we got married. My husband was also in the UK for 3 years before we filed and the K1 allowed us time to apply for my visa as he started his new job in the US and earned money so we could file the I-864 with no problems. It worked out well for us, the K1 was approved quickly.

The K1 is more expensive, but not hugely. I think the biggest thing with K1 is that you are in a kind of immigration limbo once you arrive, get married and then apply for AOS. But at least you are together for this. Again, it's different for all, some people here are in LDR and don't mind being apart, I was not, so that affected my choices.

Read up on your options, understand the differences between each option and then you can make a good choice for yourself.

It is not fraud to marry here on VWP or tourist visa and return to your country.
