Hi i want to marry my us citizen partner on a tourist visa (i've heard this is possible) and then come back to Australia and apply for a spouse visa.

My question is,

Is him having a criminal record going to be a problem?

I have never ever been in any trouble whatsoever never been arrested, so i should be fine.

Him on the other hand...

He messed up bad when he was younger. He was charged with felony eluding (an assault), and theft/robbery of a vehicle. He was wanted for questioning on a domestic violence harrasment case but was never charged for it.

I know it seems CRAZY that I want to marry this guy, please don't judge me. I just want to know if his criminal record is going to cause a drama?

I don't know about Australians getting married on a tourist visa. I married my USC spouse in 2009 as a visitor and I had the intention of doing so and so stated it at the border. The thing is, you are expecting to immigrate to the US after you are married, so they might give you trouble. I was able to do it because my wife and I were moving to Canada afterwards. You'll need a K-1 to enter to marry, I believe. If you don't have a K-1, then you'll have to prove ties to your home country (proving that you have a home, a job, etc., that you must return to after your trip.

I would apply for the K-1 if I were you. My wife and I were a special case (a Canadian marrying his wife in the US and returning to Canada with her).

I'm unsure about his record posing problems. I think I've read that this probably won't pose a problem. Someone can correct me if I'm wrong on that, though.

Well I had a criminal record (felony drug possession) but i hadnt been convicted within 2 years of filing the petition. So i didnt have to mark 'yes' to any of the questions of the application form but i know for a fact they could see that stuff on a background check and it was no problem for us. The thing they frown on the most in this situation would probably be drug charges and smuggling illegal immigrants. You would think felony drug possession would be red flag out of fear of drug trafficking, but it didnt stop us from getting an approved visa! :thumbs:

Were I am from kids do that stuff everyday. Not that big of a deal. People thought my wife was CRAZY for marrying me but we are happier than ever. You are just able to see good in people and realize that not everyone is what they did and have the ability to learn from their mistakes and change, not cast them aside for stupid mistakes they made in their past. Props to you! B-)

March 11, 2011 - Met my wife our local tsunami evacuation center due to the tsunami in Japan.

March 12, 2011 - Begin texting back and forth daily.

April 28, 2011 - :D first night with my wife to be. Officially in a relationship.

June 23, 2011 - Formally propose.

July 23, 2011 - Married in Borongan City.

August 28, 2011 - My daughter is conceived (due on June 1, 2012) :D

March 8, 2012 - Case completed at NVC

March 20, 2012 - First day of med. exam.

March 21, 2012 - SPUTUM

March 29, 2012 - 3 day sputum test NEGATIVE (culture done on May 28th)

May 25, 2012 - Alaysha Elaiah Mae Arma Nichols (MOUTHFULL) is born. 6 lbs. 18.5" and absolutely gorgeous!

June 19, 2012 - Medical Exam Passed!!

June 22, 2012 - CRBA appt. for my baby girl. APPROVED!!! :D

June 26, 2012 - CR1 Visa Interview for my wife. APPROVED!!! :D

July 6, 2012 - Passport and CRBA in hand!

July 12, 2012 - Visa in hand!

July 19, 2012 - POE LAX!!

August 1, 2012 - Green Card Received!

He has never been in trouble for smugging drugs or immigrants but i think he used to smoke a bit of weed back in the day.. but i'd be surprised if they reject it because of that. Im only concerned because he was charged with robbery... or theft whatever you wanna call it, he took a car and stole some petrol/gas!!! But anyway... thanks so much for not being judgemental. :) It means alot. Everyone has been telling me i am nuts.. my mum thinks its a little crazy but says to go for it. :) He's a really nice guy, not gang involved doesnt even have tattoos for crying out loud lol he's just a softly spoken little washington boy who got a little messed up in the past. The good news too, he's graduated with HD's from his course so I guess that looks like he's trying to make a change too.

Whats so crazy about marrying someone you are crazy about. We love our SO's warts and all (I know I have a few). Sorry just had to lighten it up. Long as its not trafficking people, abusing children and he has refrained from the past. Should be no issues. If questions come up I am sure your hunni can answer confidently to show the CO all is good. All the best to you.
