Removing Conditional Residency!

Hello VJers:

My husband is not behaving well towards me. He obtained his CR1 green card on May 25,2011.

If he wants to get the ten year green card I have we have to file in February 2013.

I don't think my marriage to him will work out, how do I make sure that he does not get

a green card through his marriage to me. He keeps telling me that he will leave me and

file an abuse claim, he said that if he does that then he can stay in the country without

my assistance. We have a six month old son. He told me that he speaks to a lot of

people and he always threatens me that there is nothing I can do to send him back to

Nigeria. How do I make sure that I am ten steps ahead of this guy, and what should

I do to make sure he does not use me? If we get a divorce can he still get his

permanent green card? Please advise.. Thanks a lot......

You can't have him sent home.

If the marriage is not working, then divorce and move on. After the divorce he can petition for the removal of conditions on his own.

The I-864 affidavit of support will still be in force after the divorce.

You CAN'T send him back!.If he is able to prove a genuine relationship he can divorce you and file I-751 waiver, and he doesn't need you to sign tho.You have a child with him and his chance to prove a bonafide marriage is really good.He will be able to get his GC without any problem,even if you divorce him.

Divore him and move on. Do not try to get revenge or the other emotions you are currently feeling. Since you did the CR-1/IR-1 visa you did not have any chance to stop the process after he was in the US. He wil have to file the ROC right after the divorce and prove the marriage was bona fide and entered into in good faith. It is his life and if he wants to stay in the US he can and you are not involved. Think of him as a USC spouse as you cannot send the USC back home--you cannot send him back home either. You are still on the hook for the I-864 until he meets those requirements.

Do whatever is best for YOU and your son and do not worry about your husband.

my thoughts to you is to try and see if you both can fix your differences and not on advice not to make him stay in the US.You both have the responsibility to cater for your son and move ahead with life.Life is more than the so call GC,Discuss your problems and see how you can fix it up with him.Pray towards it and God will see you tru
