INTERVIEW COMING UP

My interview is coming up in 4 days and of course I am having butterflies in my stomach right now. I know that during the interview, I might be asked questions that was on my N-400 application form. Anyway, to give you a background, I was charged with misrepresentation (for H1B working visa) before and overcame it with an approved waiver. There is a question in the form : "have you ever given false or misleading information to any US government official while applying for any immigration benefit or prevent deportation, exclusion or removal?" which I answered NO. Then the next question is "Have you ever lied to any US government official to gain entry or admission to the US? which I answered YES. My question is should I have answered YES too to the first question? The words "immigration benefit" is kinda confusing to me because I was on a work visa. If I should have answered yes to it, is there a way to change it during my interview when I am asked? Thanks so much. Your input is very much appreciated.

You should have answered "Yes" to both questions and that is because even a work visa is considered an immigration benefit. When you apply for any kind of status to USCIS you are really asking them to grant you a benefit.

So you should have answered yes. Now when you go to the interview you can tell the officer you made a mistake when completing the form and that you would like to make a correction. That is perfectly fine - part of the interview is to go thru the application you submitted and make corrections if corrections are needed - so no problem with that. If I were you and I had to answer "Yes" to both questions I would have an Immigration attorney come with me to the interview just in case

I would go one step further and blow the issue right out of the water. Address it yourself proactively before the interview begins. Tell the interviewer wat you told us here so that you can start with a clean slate.
