will there be a problem if k1 visa gets cancelled?

if ever he wants to file another k1 visa after cancelling the other one is there going to be a problem?

is it the same person? i mean same beneficiary? if i am not mistaken he needs to wait 2 years before he can file another petition, if the same beneficiary i think there's still problem but need explanation why it was cancelled but lets wait for other members that is expert with your situation.

It is hard to say if it will present a problem without more information, such as, who and why was the first visa cancelled? :unsure: A lot will depend on your truthful response to Part A, Question 11 on the second Form I-29F.

NO Problem IF:

The petitioner writes a withdrawal letter to the USCIS before the I-129F is approved and do a follow-up phone call to verify!!! IF the I-129F is approved before The petitioner withdraws it......He will have to wait 2years before filing another k1 visa.

BUT

He can get married and file CR-1 without an issue!!

The petitioner can get a waiver of the filing limitation. They just have to include a letter asking for the waiver when they send the second I-129F. Most of these waivers are approved unless the petitioner has been convicted of an IMBRA related crime. There are VJ members who have filed a second I-129F within two years of a previous I-129F being approved, and their waiver requests were approved.

12/15/2009 - K1 Visa Interview - APPROVED!

12/29/2009 - Married in Oakland, CA!

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!
