Hi everyone! I just sent out my I-129f packet yesterday but I have a few questions that I need help getting answers to...let me briefly tell you about my fiancé and I first :)

I live in the Virginia in the U.S and my fiancé lives in Vancouver Canada. We are planning to just get married at court here in Virginia after he get his fiancé visa approved and then we decided to move to Seattle Washington since its a few hour drive to Vancouver to be closer to his family which will lead me to question number one:

- will we be able to cross the border multiple times to pick up his stuff and move them to our new place in seattle during the 90 day period of his fiancé visa? Or would he not be allowed back into Canada until he gets his green card? He was going to just bring himself and fly to Virginia to get married and then we were going to drive to Seattle with my stuff and get a place and then once we have a place drive up to Vancouver and grab his stuff to move to Seattle but we were afraid they won't let him re enter USA.

-next I wasn't even sure if we were allowed to move from virginia to seattle until he gets his green card. If we are should I file for aos and employment permit and stuff after we get a place in Seattle? That way everything doesn't get sent to my mothers house in Virginia? And do I have to notify someone that were moving during his fiancé visa? If so who?

If someone can clear that up for me that would be awesome! THANKS A LOT! =D

He can't cross back and forth on a K-1. It's to enter the country. Then he can't leave without AP - which you file with the AOS & EA.

Just a thought: he could activate his visa by crossing over with his stuff in a U-haul and put it in storage in Seattle then fly to Virginia from SeaTac. The flights are normally cheaper from there anyways.

  • I believe (I could be wrong and if I am I am sure someone will correct me):
  • Once your husband to be enters on the K-1 he cannot go in and out of the country until he has advance parole (processing time is around 3 months from AOS). If he leaves before that he will not be allowed back in and you will have to file for CR-1.
  • You can move and live where ever you want you will just have to notify USCIS.

thanks! i'll definitely talk to him about hauling his stuff to storage in seattle didnt think of that before..and yea flights are tons cheaper in seattle thats where i usually fly to when i visit him plus border crossing is alot easier by driving then customs at yvr >.< oh and one more thing... does he apply for social security right after we get married? before the AOS?

As others have stated, the K-1 visa is a one time entry visa and becomes null and void when used to enter the US. It will be replaced with an I-94 that will be good for 90 days. You must marry within those 90 days and then file for AOS. He can apply for his EAD and AP at the same time which will allow him to work and be able to re-enter the US should he travel internationally while waiting for his green card to be approved. Once he enters with the K-1, he cannot leave until he has AP or his green card in hand.
