Me and my USC wife had already filed our divorce paper 2 weeks ago. she became uncooperative and hard to deal with in every way. i caught her 2x fooling around and doing drugs which resulated to our separation. i got my conditional card Oct 2011 but she decided to abandon me last dec 2011 and move somewhere else. and now that we are separating, the fear of her retaliating never stops. this is why i posted something about travelling as i have to go back to my country for a serious family emergency but fear that she might do something stupid and report false information about me and that i may have a problem coming back. i am conditional and i feel helpless and have no choice but to submit myself to whatever her condition is.

whats the advantage/disadvantage of filing, divorce and self petitioning as opposed to just waiting for my ROC next year June 2013 but got no evidence to show after she left december 2011. marriage was entered in good faith. i have tons of evidence prior to dec 2011. will the journey be tougher?

please help.thankyou very much

you don't have two options (divorce and self petitioning or just waiting for my ROC next year June 2013). As soon you get your divorce decree you should file the I-751 waiver. Once you file the I-751 waiver you will receive the extension letter (valid for 1 year) and you can travel abroad without any problem. You must prove your relationship with her until the time she left you ( December 2011), you don't have to prove anything after that.If you have proof of a bonafide marriage you will be ok.
