If my fiance using a co-sponsor(his father) for income and such does the co-sponsor fill out the I-134 or ? can u please help me out!Thank you :)

Yes. They each fill out their own separate I-134.

Does your fiance live with his father? If so he'll have to fill out an I-864A at least that is what USCIS said to me. Since my father will be my co-sponsor and at the time of filing I am living in his home.

Does your fiance live with his father? If so he'll have to fill out an I-864A at least that is what USCIS said to me. Since my father will be my co-sponsor and at the time of filing I am living in his home.

This is not so for a couple of reasons. One is that most consulates use only the I-134 for K-1 visas. The I-864 is used for those that are already married filing for a spousal visa or adjustment of status. The second reason is just because you live with someone does not mean the other person must fill out an I-864A. You can live with someone and have both fill out an I-134 or both fill out an I-864. Where you reside is not the only issue and requirement for the I-864A.

The I-864A is used for a qualifying member of your household to combine their income with the sponsor filling out the I-864 to meet the 125% requirement. A lot of times, especially if neither the primary sponsor or the joint sponsor are dependents of each other, it is best for them each to fill out their own separate I-864 forms anyway, even when living under the same roof.

For the K-1 visa though, not many consulates use the I-864 and I-864A. They use only the I-134 and the petitioner and the co-sponsor will each fill out their own I-134, as I stated. There is no combining of incomes. The co-sponsor must qualify on their own at the 125% of poverty level for their own household size plus the beneficiary.

If you want to make absolutely sure your consulate only deals with the I-134 for K-1 applicants, then ask in your regional forum for those that have gone through the same consulate as you will, and/or ask your consulate directly, not the USCIS misinformation line.

I went through the same embassy, and we were in the same situation - my husband (then fiance) used his dad as a co-sponsor. They both filled out the i-134. Make sure you have all the supporting documents for both of them, too.

For the Embassy in Sofia, you don't need the i-864 or i-864A.

10/22/2014 Early Biometrics Walk-in - Cleveland, OH - weird experience with the clerk there - told me I can go ahead and get my biometrics taken early, but it might be too early and it might not go through??? If it might be a problem, then why let me do it at all?
