Hi. My husband (USS) is planning to get his brother in law as our co-sponsor. His brother in law is self-employed but he has many properties. We dont know if he will be qualified.

What form does he need to fill out just in case he is qualified? and how much he has to have to be qualified. and how many household will be counted?

Please help me in this matter.

I think his brother-in-law needs a copy of his income tax return so they will see how much income he makes.

or a copy of his bank statement. I have another option for your husband, no harm in trying anyways.

Hi his brother in law said that he made 40k but in the ITR only 11k. I dont know what year is that.

I am confused if we will be alright if the brother in law will be our co-sponsor.

If his ITR said $11K then he does show enough income to be a joint sponsor.

There is actually no such thing as a cosponsor. It's just a term we use for an additional sponsor in K visa cases using the I-134 instead of the I-864. The joint sponsor must qualify with income or income and assets based on their own family size plus any intending immigrants, plus previously sponsored immigrants, if any. How much income depends on the household size calculation for that individual.

Frequently, people who make their income from rental properties, will show a low income on tax returns. While they CAN use their assets like the equity in their real estate to help qualify, the real estate must be appraised. Most don't want to go to the expense. If they have significant liquid assets, like cash, mutual funds or stocks, those can be more easily documented.

Facts are cheap...knowing how to use them is precious...

Make sure your husband can still show the consolate proof of domicile in the states since he has been living here in the Philippines for an extended time. I've been here this time for 6 moths straight and today at my wife's interview, they wanted to see my proof of domicile in the states which I provided in the form of bank statements and state income tax return.

10/01/2010 -- Met online

11/03/2010 -- Arrived in PH

4/20/2011 -- Married in PH

3/08/2012 -- Filed I-130 with USCIS Manila Embasy

5/17/2012 -- I -130 Approved

5/24/2012 -- Submitted Packet 3

6/04/2012 -- Medical

6/18/2012 -- VISA Interview - Approved

6/21/2012 -- Recieved VISA

7/03/2012 -- Fly to the States
