Hi Vj members, I filed i129 couple of weeks after filing i130. At the time of the filing, I knew nothing about Vj website and they members. My i130 got approved on the 5th of June. At this point, I thought USCIS will stop working on my i129. Well, I am wrong. Today the 13th of june, I got a REF for i129. I called USCIS to withdraw my i129. The lady told me to write CSC in Laguna Niguel CA where my case is located. My fellow Vj members what should I do? Just write them like she said or ignore the REF? please I need u guys advice. Thanks

What was the RFE for? Is there a way you can call the CSC in Laguna Niguel CA, give them your I-129 case number and approved I-130 case number?

Then you can explain why you filed both. I'm going to assume it was because you thought the K3 was still valid and went' about filing that process BECAUSE THAT IS WHAT THEIR WEBISTE DIRECTED YOU TO DO...not knowing the K3 were no longer valid in Nigeria.

If you can't contact them by phone. I'd write a letter and send it overnight priority mail and include both of your case numbers on the letter along with the RFE (and any documentation they felt you needed to forward to them for that) and prayerfully, they will just close it out and send it for interview scheduling.

Whatever you decide to do. Just do it quickly so you don't throw up any red flags to them. I called the NVC today to ask a question...and boy what a RUDE and RUSHED response I got from them like I was just wasting their time. Last I checked... it think it is "our love for our spouses and the money spent on the immigration process that pays that RUDE ladies time for sitting there everyweek! :bonk:

Don't let anyone get you down or discouraged today. Just keep pressing forward. Be kind in your explaination if you call, "even if you point out their website discrepancy", and everything will be fine!

Keep us posted on how you go about this and the results you get. I made this same mistake as well, and like you, I have two petitions floating! :unsure:

Thanks Dana&Divine for the advice on my post. The REF asked for complete filled out form of G325(biographic form). I have no direct number to contact CSC in Languna Niguel.

Are you going to send the form they need (so they can see you are complying in every manner) and cancel your petition all at the same time? I always thought, that the I129 would cancel out if the I-130 was approved, or they would just merge together and move forward. I filed my I129 through Texas I believe and the I=130 went prior to that to California.

I pray everything is handled quickly for you! SO you can get on with the NVC process and get you baby home!

If you do nothing, the I129F will die off

If you call them, you can cancel it

regardless, you don't need it nor do you want it

the I-797-C receipt notice for the I-129F contains the address that you should write to.

OTOH, there's an address with the RFE as well, so if you'd like to be 'complete' - send a withdrawal letter on the I-129F to both addresses.
