Hello Everyone,

My Fiancee is now in the US on K-1 visa (less than a week now) & we were planning on getting her SSC on her maiden name.

One of the questions on the SSC form

Citizenship

  • Legal Alien allowed to work
  • Legal Alien Not allowed to work

Please can someone confirm which one need to be checked (allowed to work or not).

Can we file for EAD before marriage or should wait to file along with AOS?

Also how difficult or easy is it to change the name on SSC once we are married?

Thank You.

Allowed to work.

You can, but that's kind of a waste of money as the EAD will be valid until her I-94 expires (counting that it will take 2-3 months until she receives it.. so it may only be good for a few weeks). If you file at the same time as the AOS, it's free and valid for a year.

I didn't do it yet, but seems easy. The social security employee told me to come back with my marriage certificate and EAD (when I have it), and they will change the card to my married name.

She is a Legal Alien allowed to work.

File for EAD and AP at the same time as the I-485 and the fees for those are waived. Paying for the EAD before filing AOS is a pointless waste of money since the EAD she would receive would expire when her I-94 does.

They are supposed to change her name with just the marriage certificate, but sometimes SSA states they need the EAD or green card in her married name first. If you do it that way, I would wait until you had the green card. Then you can change it to her married name and remove the notation that states "valid for work only with DHS authorization" at the same time.
