i have a quick question guys..i have a friend who is truning 21 next july 20th..her father petitioned her a couple of years ago as a GC holder now he is a US citizen and they are finally waiting for the intervie..they are expecting a july date for her and her brother and sister...would she be able to get a july date beforeher 21st birthday???and since her father is a US citizen will she become a US citizen because of her father???

Her petition would have converted from F2 to IR2 as soon as her father became a US citizen, presuming he notified USCIS or the NVC. Her age would have been locked on the date the petition was converted. It no longer matters how old she is when the interview takes place.

She will not automatically become a US citizen. She would need to have been admitted to the US for permanent resident status before she was 18 in order to automatically acquire US citizenship through her father.

08/18/2010 - AOS Interview - APPROVED!

05/01/2013 - Removal of Conditions - APPROVED!

1. nvc know of uscitizenship status , or no?

2. can request expedite from nvc, citing 'potential age out' , if the cap is age 21.

mariel i send out the I130 for my stepdaughter when she was 17 she now 18 the age gets lock in on the year status from when they received the application, it doesnt matter the age only the age from when it was filed... good luck to your friend

yup it doesnt matter she woulb be a green card holder she wont become a citizen
