Hello,

My wife is a few days from her interview and while at the hotel they have a person who helps them with the documents. With this help she is now worried we did the AOS stuff wrong.

I am a college student and I still live at home. So my dad is our joint sponsor. I filled out my I-864 form and my dad filled out an I-864 form as well. My wife is worried that both my parents needed to do the I-864a forms because my parents file joint taxes and my dad listed the joint income on his I-864 form for the income of the 3 most recent years and that my mom didn't fill out any form. My dad called the NVC about that and they said that's fine to do it that way. We sent the NVC, through the EP, my I-864 and my dad's I-864 with my parents joint income. Was this a mistake? and how can we fix it?

You both filing out the I-864 is correct, no doubt about that.

Did your mom fill out a I-864A or anything? You said she filled out no form, if her income was being counted and with the joint taxes, she should have filled in a I-864A. You could see if FEDEX can get it there in time, or at least fax a copy.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You and your dad submitted the correct form (I-864). The Consulate may or may not decide they want to see an I-864A from your mom as it is they and not the NVC who make the "likely to become a public charge" determination. To be on the safe side and if you can, express an I-864A filled out by your mom along with necessary accompanying documentation for your wife to hand over at document intake.

August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online

Hello,

What if we adjust the income such that it's just of my dads on his I-864? All my wife would need to would be to print out that page since we used the computer to fill out the I-864 forms to start. My dad him self made enough to be a joint sponsor. Thank you.

He'd still need to sign a new form, so it'll be the same issue of courier-ing the forms over.

If your father's own personal income is enough to qualify and you have at least the most recent tax return copy including his W2 form, you're probably OK with what you have. If you have an employer letter or pay stub to verify current income (Tax returns are about the past.) that will be better. Your wife is wrong about the need for an I-864a from your father. If properly documented personal income from Dad is sufficient, no need for anything from Mom.

Hello,

Actually I sent my wife a signed page # 8 of both my and my dad's I-864 forms. I just sent her those because she can print off the first 7 pages. What I am suggesting is adjust question #25 on page #4 to just show what my dad made and have my wife print it off and switch them. All the pages except the last for both my I-864 and my dad's I-864 were filled out by typing. My mom no longer works and that's why she didn't fill any form out because it would show $0 for current income. Thank you.

That should work nicely as long as she has the complete tax return including our Dad's W2 form. Did you also provide an employer letter or recent pay stub? If not, I would get a recent pay stub, scan it and email it to print and take to the interview.

Hello,

Yes, my wife have copies of 2008-2011 tax returns with respective W'2s, 2008- 2010 federal tax transcripts, and a recent pay stub from my dad (mid April 2012. The transcripts don't state what my dad earned from what my mom earned. So the returns/ W'2s will be more important for our case.

Yes, my wife have copies of 2008-2011 tax returns with respective W'2s, 2008- 2010 federal tax transcripts, and a recent pay stub from my dad (mid April 2012. The transcripts don't state what my dad earned from what my mom earned. So the returns/ W'2s will be more important for our case.

Hello,

Another concern popped up. My wife is being told that my mom needs to do a I-864a form. My mom no longer works and my dad makes enough but because they file joint taxes my wife thinks she needs to do one. What I am thinking of doing is this. Have my mom do a I-864a and attach it to my dad's I-864, since it's including her income to my dads. Then on my dad's I-864 which he claimed my mom as a dependent, have him change the information on question #24b and check box "d?" Or have her do the I-864a and attach it to my I-864? Or not attach it to either I-864 forms? Thank you.

We already covered this. What "your wife is being told" is simply wrong. You have it handled properly now.
