Hello VJ.. I would like to know if anyone knows about the appeal process?. I just recently sent my appeal off,. I was denied because, I did not enclose any paperwork with my I129F. I understand that it may take up to six months. If there is anyone out there that went through an appeal process, please advise. Thanks for reading. Have a bless day!

Okay when you say appeal what do you mean? I see you filed your petition in November? So are you referring to a RFE (request for further Evidence)? Also when you say "I did not enclose any paperwork with my I129F". Do you mean you just sent in the forms and no evidence?

The more information the better we can answer your questions as to how to guide and advise.

Okay when you say appeal what do you mean? I see you filed your petition in November? So are you referring to a RFE (request for further Evidence)? Also when you say "I did not enclose any paperwork with my I129F". Do you mean you just sent in the forms and no evidence?

Dear Gemini70: First let me apologized for what you are going through. I will say that i did the same thing as to filing without any suppporting documentation (thats another story). Personally I refused to appeal it being that they requested $630 on top of the $320 they had receive for my I-129F Filing and it will eventually extend the process for you. We decided to Just get married and I have filed the I-130. That is just my opinion...

They stated they got a denial, not an RFE.

Well I asked RFE because they are in the USCIS stages if the timeline is correct that's why I asked. Never heard of an appeal at the beginning. Appealing what? If no evidence was sent in I would think there would be an RFE. Just some clarification would be helpful.

Well I asked RFE because they are in the USCIS stages if the timeline is correct that's why I asked. Never heard of an appeal at the beginning. Appealing what? If no evidence was sent in I would think there would be an RFE. Just some clarification would be helpful.

If someone sends in just the I-129F, which is what it sounds like the OP did, they will not get an RFE for everything else. They will be denied.

Yes.... it was sent without any suppporting docs... it does hurt... I wanted to just get a final decision, then reapply and only pay 340.00, but.. with the supporting docs I just appealed it. I read that the same AO will review my file again with the supported documents added. The time is about the same time frame. But I thank u all for the support and understanding... I. do feel a lil better, but sometimes I just want to pass out. I have had some great help from ROCKS. She is my angel. She helped me all the way to this process. She did not throw dirt in my face, because she had compassion. Even though some people make mistakes, we do not need some people going off about you should have read this and you should have read that. It's a journey, and we all are connected somewhow. Thanks gracenp2.

We went through a similar thing and after nearly 6 mths were ultimately denied.

We had left out some documents. When we discovered that they hadn't gone in the envelope we sent them with a copy of the NOA1 we received. The remaining documents never connected with our original petition. We were going to appeal, but ultimately decided not to. It is quicker and cheaper to start again. I know what you are going through... it is heartbreaking. All the very best with your new petition and hopefully it will be approved in a reasonable time. (F)

Mar 2011 - After 5mths denied for lost docs - Attempts to follow up failed. Mar 18 2012 - I-129F sent - No sign of NOA1 but they have banked the check...Jul 24 - Update - USCIS has located our file
Infopass Apt - they sorted through everything - our 2011 and 2012 file keep getting mixed up - getting us a Case# (still waiting) Dec- Infopass Appt- expecting to get a case # in about a week ..Still no Case number

Mar 2013 Infopass - advised file was in a box somewhere,and it would be quicker for us to refile. Life gets in the way... New petition submitted July 2014 .
