Hi everyone,

Just a simple question..my auntie is a greencard holder but she is staying here for about 2 years now. She wants to go back in the US. The reasons why she's staying longer is because of her husband illness. She accompanied her husband due to heart attack. Is there any way to go back to the US since eventually abandon her residency?

not easily....this is why you apply for AP....so you can come back after an overstay.... easiest way would be a relative to sponsor her.....I really doubt if she can get back any other way....

02/11/2011 - Engaged at her house by her Godmother.

02/18/2011 - Engagement party with relatives - propose in Visayan.

02/24/2011 - K-1 packet sent.

09/18/2011 - POE, Viva Las Vegas, Baby !!!!! Home to Phoenix.

12/10/2011 - Official Wedding

07/05/2012 - Princess Rose born.

07/07/2012 - AP/EAD received.

07/17/2012 - AOS passed. (Birthday for Mama Rayos)

just for clarification, it's not AP. it's a reentry permit.

I don't know if she's eligible. maybe she could get a returning resident visa.

Does she have a reenty permit? Otherwise, her greencard is no longer valid.

Like Boiler said, SB-1 which is a Returning Resident Visa.

She'll need to demonstrate that she didn't intend to remain out of the US for so long but was required to due to unforeseen reasons. Sounds like her husband's decline in health might be just such a reason.

I meant form I-131 but marked differently for a re-entry permit (a little different from AP BUT it IS the SAME form.)

Here is the information I was looking for: this should help if she did not process a form I-131 BEFORE she left.

I guess that's as close as we'll get to you admitting you made an error. something I saw you post in a different thread. just FYI, the I-134 is not legally binding.

The forms (DS-117: Application to Determine Returning Resident Status and DS-230: Application for Immigrant Visa and Alien Registration) may be picked-up in person or by a representative at the Embassy.

And, of course, the Reentry Permit would had to have been obtained in the US prior to leaving on this trip. No reentry permit, then follow the course Bob 4 Anna and others laid out.
