Change of Name and Filling I 485/ I130

My fiance and I are getting married next month (June 2012). Right now I overstayed my visa. I have applied for OPT (student pos completition) after my F1 visa ended. I have a work permit granted from January 2012 to January 2013. According to my school, I had 3 months to find a job, otherwise I would have to leave the country. I could not find a job and that grace period ended o April 2012. Now I face a dilemma by filling the forms I-485, I-130 etc... I really want to prepare everything in advance, prior to my wedding. I really want to carry my husband's name when we get married, but I am scarred to got to the Social Security to change my name after we marry in court and before applying to the GC. What should I do? Please HELP!

Since you overstayed your visa, I suggest you change your name after you get your greencard.

I don't know how the social security system works, so i am not sure if they will overlook your situation and let you change name.

I heard that you can file with your maiden name, and when you go to your interview, tell them to print your married name on your GC.

That's what I am going to do. If that's not working, I guess I will wait till ROC.

No, you don't need to update SSA first. Just fill out the forms in your new name. When you get your EAD or Greencard you can change the name on your SSN.

Nope, I know for a fact it will not. USCIS deals with this problem every day. You will be presenting your marriage certificate which for USCIS is a valid name change document, and I promise they can figure out. Like I said, they do this every day.

That is correct! However, I already have a SSN and that information is needed when filling the I-765 petition to work that goes along with the I-485. Since I have filled the I-765 before ( for my OPT student post completion) I'm concerned to have to apply for the I-765 petition under different conditions. And, therefore, provide my maiden name..

All this is very new to me and all the answers are valid for sure! I do not intend to make a fuss with all this but discuss and share common experiences.
