I'm always on visajourney but never really posted anything. Since this is such a good site I had no problem finding solutions if I come across a problem. Now I have a problem and hope you can help me.

A little background, I came to the USA in 2008 on a visit to my adopted family( not on paper but they raised me since I was 3 days old). While here they started a janitorial business and asked if I would stay to help them out. I told them I didn't want to mess up my visa but they said they knew a company in Florida that would help me to get a h1B visa so I wouldn't have to go back home. I met with the ppl from the company and they told me it would cost $6000 to get the paperwork done and the procedure would take about 280 days to complete and I can't go back home once I signed up. It seemed like a good thing at the time so I signed up for it but about 4 months after I signed up I was notified that they went into bankruptcy and the police was looking for them bcuz other clients were duped in this work permit scam. My I-94 was now expired so I knew if I went back home my visa would be taken away. My adopted parents felt bad by the whole thing but what could I do. So for that mishap I was now out of status in the USA.

In 2008 I met the most gorgeous man ever and we dated. I got pregnant and had a baby in 2009. Even though we had a child Im not one to get married just because, I wanted to be sure I was in the right relationship. Don't get me wrong my husband is wonderful but marriage is a serious thing something I don't take for granted.

We got married in May 2011 and filed I-130 and 485 in Dec.

We went for interview this morning and I don't know what to think.

We were asked to present all original copies of birth certificate, marriage certificate, citizenship certificate and my daughters birth certificate. We were then asked for joint documents, pictures and my I-94. She then told us she was gonna ask questions and only the person who the question was directed to should answer.

Questions and answers

What is your wife's full name. He gave my full name

When was she born. He gave correct month and year but wrong date

Where was she born. He said Jamaica

Where in Jamaica. St. Catherine. Wrong I was born in st. Ann but I was not upset because I was born ther but raised in st. Catherine

What is your husbands full name. I gave full name

Was he married before. Yes

Does he have any kids. Yes

How many. 7

What are their names. I gave all names

Does your wife have any kids. My husband was I don't know

Does your wife have any kids. Here, no

Does your wife have any kids. Other than my daughter I don't know of any more

Isn't your daughter your wifes child. Yes

So does your wife have kids. Yes

We then went through the yes and no questions then she wrote in my passport that we were there for an interview and told our case will be under review and we will get a letter within 60 days.

I am so upset with my husband how can he say he doesn't know if I have any kids other than my daughter. That is like saying I'm hiding something from him. I don't know what to think right now. They kept my I-94 but didn't ask for further evidence so I don't know if this is good or bad.

It takes more than that question for a denial. They know interviewees get nervous. Don't worry, most of us are told our case is under review and we get approved after. You both seemed nervous based on your report of the process. Relax. All the best.

Rest your mind. I am sure its just to check out the issue with the I-94 or they didn't have enough time to review all the documents. Looks like you had everything in order. They know they try to trip up folk on questions. Its okay. You will get that good news soon. BREATHE!!cool.gif

I guess I'm just upset with him because of his reply and is overthinking stuff right now. I must admit though he played it off real good as he had the IO laughing most of the time. Apart from those issues it was a good interview.

They won't just deny you. If they doubt the authenticity of your relationship they will either RFE you or schedule you for another interview to interview you both separately. Not much to do but wait now, good luck!
