i have a friend who needs help and i know she is really stress now thinking of what to do exactly. i am hoping guys you will help me about this matter so i can give more advice to her and tell what to do.

she have adopted son from her cousin but no legal docs handed all she did is he register the boy to her name so she have NSO birth cert. they are under K1 visa. the problem they got is the st lukes found out that the girl never give birth so she did tell the truth. she is really worried if the doctor from st lukes put that to her medical report that the boy is adopted and no signs of giving birth because she keeps thinking if she will bring her son or not too. it takes time to fix the legal adoption and her fiance made a letter of intent for financially and emotionally and etc support for that child and letter that he is willing to adopt the lil boy.

so i would really appreciate if you will give us advise regarding this matter.

Short answer, almost impossible for the not really adopted child to obtain a visa.

Even if you went the legal route to adopt the child there is not much chance of getting a visa since the child has at least one natural parent living. That's not just US law, it's Philippine law.

There's no fast way to correct this!

First: never lie or miss-lead any official in this process, it will haunt you!

Second: File formal papers to legal adoption the child, there is no way around the law!

Your friend may have much bigger problems than a K1 visa issue.

It's hard to tell from your description, but if she did a "simulation of birth" and St. Luke's reported the matter to the authorities, then she could be facing criminal charges and prison time. I'd say that she'd be well advised to consult with an attorney ASAP.

She has to file an adoption proceedings in court. Since the boy is a relative (her niece by her cousin), it would be very easy for her to adopt him. I am working in a Family Court and we have those cases here. There are cases in our court that petitioners are biological parents but DNA test done at St. Luke's does not match so they require the petitioners to undergo adoption proceedings. Have no idea if the doctor would state that in his medical report. Anyway, good luck to her!

This is exactly

why it takes 23 years for a family to
bring their siblings to the US. Scams like this have made it immpossible for the US to know who is indeed natural siblings/children. This will only compound the situations and the time line could grow to 50 years. Edited by LIFE'SJOURNEY
