lol OP you're being so casual with the "i was also a beneficiary and was married for over 5 years so i can get my citizenship..." why is USCIS so concerned with me now that i want to petition for another marriage visa...you have the biggest red color flag in the neighborhood! expect major road blocks and delays ahead.

also people should be honest and learn to self-audit your situation before getting your local senator's office involved. leave that avenue for someone that actually need the help instead of being selfish and clogging up the system.

This is a big deal NOW because you are trying to bring another person to the United States. USCIS has no control over your divorce, but they do have power now. This kinds of scam where a person scams an USC for permanent status, divorce, then apply the real love to the states happens a lot. You just have to wait!

If I was in their shoes, you are waiving a red flag.

I been living USA over 13+ years always maintain legal imigration status. I meet my previous spouse and we got married. But things happend which I dont want to put details here, so we got divorce. My current marriage is an arrange marriage. I knew her 2 months before we got married last year. We talk over the phone and my parent went see her in person. I didnt do any scam.

In our culture arrange marriage is very common. But since I left for USA, we have phone record that can proof that we talk atleast 2 calls thru skype or phone everyday(every single day) for few hours. She live with my parent now. After reading some other post another flag could be agre difference, we do have age difference of 11 years. But thats common in our culture too. My parent, inlaws, sister in law has similar age difference between them and their spouse. I know there is some kind of red flag in my case, not sure which one, but I am optimistic that everything will be fine since I havent broke any law. But it's heart breaking for both of us that it going to take another 10+ months (uscis+nvc+embassy) after waiting for 7 months.

OP your current status for processing is based on the many red flags you have listed. Somehow, you are still not recognizing YOUR own red flags. Yes, arranged marriages are common in your culture. Age difference is also common in your culture. Unfortunately, what is common in your culture is also common in fraud. As others have stated "arranged" marriages can also mean "paid" marriages just for opportunity purposes to arrive in America. You arrived in America via immigration purposes. Even though your marriage was authentic, USCIS want to also make sure your NEW marriage is authentic as well. Think of it as being "common in American culture". The background checks and waiting is not to convict you of being guilty for breaking the or any law. However, laws are in place to deter people who might.

I hope someone can advise me on this. I file I 130 for my wife dated 10/6/2011. After 7 months I contacted USCIS thru senator's office and got following reply:

"A check of USCIS records indicates that this case is currently under extensive background check review and it should be processed within 180 days. We apologize for the delay and inconvenience caused. Thank you and have a wonderful day."

Neither me or my wife ever broke any law (except speeding tickets). She never been to USA. We have wedding videos, pictures.....anything they can ask for to proof that we are married. They didnt ask for RFE.

I got my citizenship thru prior marriage which lasted over 5 years. We got divorce in good term, wasn't a massy divorce.

My questis are:

1. Did any one of you had similar situation? If yes how long it took you to go thru the process?

2. Do you advise that I should file I 129f?

3. I contacted Citizenship and Immigration Services Ombudsman today. Will it help?

Hope someone can help me.

I got my NO2 approval today!!!!! Thanks VJ members for your inputs. Now time for preparing NVC filing.
