Hello Everyone,

I met my fiance through a social network called Hi5, four years ago. We exchange numbers, we chat online, I've travel on numerous occasion, he proposed on new years, everything is wonderful and we are growing closer together and would like to have a family. I am submitting the petition for a K-1/k-2 visa today (wish me luck) I followed all the steps and I have been traveling to the Dominican Republic quite often. He has a fun 3 year old son and we developed a great relationship. My fiance has has full custody and the kid is very smart and alert for a 3 year old, sometimes I wonder if he is really that age LOL. Anyhow the issue that I need help with is once I submit the petition and everything goes ok, do we need a sign consent from his biological mother eventhough my fiance has full custody of the child?

I was thinking since we have court papers saying he has full custody of the child, that we don't need to have her sign a document so he could travel.

Please advise! Not sure what to do.

Make sure you check with the embassy there to understand exactly what they want & will accept.

Sounds great. Thanks for the add. Make sure you read up on the Follow-to-join requirements. Make sure your fiance has all the necessary paperwork to bring his son over. Legalized Birth Certificate (extensa form).

I don't think he needs that paper but I will honestly have it Because you don't know if it's necessary here to be able to enroll him in school. My fiancé needed his daughters mom information to get the passport who's gonna be 2 next month and they didn't ask him anything about her giving him permission. Not sure if it's mandatory in your situation..you should ask a local notary or have your fiancé find out from an immigration office out there to be on the safe side.

thanks everyone for the info and lynks, I will be traveling next week and I will go find out at a family court and will be calling the embassy, wouldn't want any issues trying to get him out of the country.

Depends on the court order and the consulate rules. He will need specific permission to allow him to relocate the child PERMANENTLY to the United States, either from the court order or by written permission of the absent parent.

Without reading the court order I do not know if it specifically allows him to remove the child to anywhere. "Full Custody" is not the same as being able to permanently relocate the child anywhere by his own decision.

I would suggest you contact the consulate and ask them, it is not something you want fo guess about.

I also have sole custody of my children, but I went back and got a new court order stating that I was allowed to relocate the kids to the United States. My ex and I mediated a new custody agreement with this in place and a new visitation schedule and child support etc..

I would check with your consulate just to be on the safe side. You would hate to have problems in future. Best of luck to you! :)

Hey guys I went into the Dominican Embassy website, they redirected me to a lynk at the attorney generals office, where they have a department that its in charge of the requirement documentation a child needs to travel and live at another country. I am excited :dance: it says that along with the court order we need to add a clause that says that we are relocating to another country and that the biological mother will need to agree and sign the notarized document, we pay a fee and that's it.

Do you do this if it's permanent? because my fiance's daughter is coming also but she's only coming for a few months.

Yes he is staying with us permanently, if your step-daughter is only staying for a few months then you should be ok just having her mother sign a notarized consent and take it to "Direccion General de Migracion, and their number is (809) 508-2555 or check out their site www.migracion.gov.do/per_menores.html...: once you call them ask for the requirement for "Permisos para amenores and the fee is $1,000 dominican pesos

I guess they need to approve the permission that way you and your fiance would not have any issues once you leave DR.

She's coming on a K2 visa with my fiance. She's not going to live here for ever, only for a few months, but after I read the website I saw that it's for anyone, even if they come for 2 weeks, children under 18 must get a permission from the public office of imigration that allows them to leave the country. We got the letter that's needed notarized to obtain the permission from the immigration office out there.
