AlHamdulillah :dance: , Got the Text and Email an hour before. Thanks to all VJ'ers for their great support.

Looking forward I stumbled into few questions.

For Next step,

- NVC and consulate website states there is a $240 visa fee. Is this part of the fee I paid when filed at USCIS ($340) or is this separate that have to paid to the Consulate/NVC. If it is separate, when and where do you have to pay the fees? :help:

After she arrives:-

- I am confused because my Lawyer told me last year that I would have to file for I-130 along with I-485 after getting married when she gets here. However, in the VJ next step guide it only mentions that I have to file I-485 along with AP and stuff. So confused whether I have to file for I-130 or not when adjusting her status. :help:

Appreciate all the help.

If you have done a K1 (I-129f) the fee to file the I-129f was 340.00. The fee you pay for the visa interview is 240.00 provided you have no K2's if you have a k2 you need to pay an additional 240.00 for the interview.

You also have a medical fee to pay which is different than the Interview fee.

Yes, the visa fee ($240) is a different fee than the petition fee you already paid ($340). It will have to be paid after your case left NVC, so at the consulate stage. You DO NOT pay this fee to NVC (it's for spousal visa, not fiance).

No, you won't have to file the I-130 form, your lawyer is wrong. Do no do it and pay for it or you're gonna waste money...

"If I choose the fiancé(e) visa option, how does my fiancé(e) obtain permanent resident status?"

and "What if my fiancé(e) is already in the United States in another status and we decide to marry now?", in that case, you file for the I-130. But as she will enter with the fiance visa, then you don't file for the I-130.

Thanks, I did a K1. Do you pay that to Consulate or NVC. Also, is the payment collected from me or my Fiancee. Just trying to figure out whether I should send her a check for the consulate for $240.

I don't believe that I-130 is used in the K-1 process, review the K1/K3 AOS guide, for details.

I think you know this but reread the guides, and then look directly at USCIS. Your Visa fee at the embassy is different than your petition, also you will have medical look at others from your embassy and see what they say. After you are done with your K1 you can do your AOS yourselves.
