I am a USC and will be applying for my wife who is in Pakistan. I have been reading a lot lately on this forum and appreciate all the info.

To make a long short story short, its an arranged marriage. Our parents want to do the Nikkah first but they want to do the mehndi, baraat, rukhsti etc six months later. As anyone from Pakistan would know, Nikkah is the actual marriage but since we are not doing the Rukhsati right now, me and my wife will not be living together until six months after the nikkah. My question is that should I go ahead and apply for her right away after nikkah or wait another six months and apply after we have lived together for some time.

My parents want me to file after Nikkah. If I do so what would be my answer to Q#21 on I130 which asks "If filing for husband/wife, give last address at which you lived together"

i never lived with my spouse (who is indonesian). We married, and i filed the I-130 as soon as we have Buku Nikah. I dont know anything specifically about pakistan that might change this answer, but you should be able to file the I-130. Perhaps someone from pakistan will drop by and answer soon.

You can apply for visa for your wife, right after the Nikkah is completed. You need don't need to live together to be able to apply for the marriage based visa. Because for USCIS, nikkah counts as official marriage contract. As far as question number 21 on I-130, can you put "We have visited but not lived together yet". Good luck.

A/A

Since the process takes so long I would file as soon as possible. I don't have exactly the same situation as you, but my spouse came over from Egypt to the US to make Nikkah with me, and returned home 2 weeks later. Our big ceremony will is'A happen at a later date in Egypt when we are ready for him to immigrate here and begin our lives together. If the experts here are right, we are looking at a year or longer for immigration proceedings.

We married 3/9/12 and our I130 was accepted on 4/23.

You can apply for visa for your wife,

Just to get semantics out of the way, a US Citzen does not apply for a visa for their foreign spouse, they file a petition for an immigration benefit for their foreign spouse. Only when that petition is approved does the foreign spouse apply for a visa.

My parents want me to file after Nikkah. If I do so what would be my answer to Q#21 on I130 which asks "If filing for husband/wife, give last address at which you lived together"

An acceptable answer for that question is "we have not yet lived together."
