Timeline

My husband is a self-employed but he asked for an extension this year to file his taxes. Is it ok to send the one for 2010? He did file his personal taxes but I think it's not enough. Should he just send the one for his business (2010) with an explanation of why it wasn't file yet this year? Thank you

Day 1- Package sent to Chicago Lockbox 06/12/2012

Day 3- Package received 06/14/2012

Day 7- NOA's emails received 06/18/2012

Day 10- NOA's Hard copies received 06/21/2012

Day 18- Biometrics appointment notice received 06/29/2012

Day 32- Biometrics done! 07/13/2012

Day 59- Online update - they mailed me a notice - interview scheduled for September 13! Soooo happy! 08/09/2012

Day 94- Interview done - wait for NOA2 in the mail 09/13/2012

Day 95- I-130 Approved - NOA2 in the mail (online update) - I485 still on "interview notice" status (09/14/2012)

Day 98- Online update on the I-485 - they mailed me a welcome letter!! :) (09/17/2012)

Day 101- Online update - On September 20, 2012, we ordered production of your new card. (09/20/2012)

Day 102- online update - On September 21, 2012, we mailed your card to the address we have on file! SUPER HAPPY!!!!

Day 105- Received Green Card in the mail! (09/24/2012)

For a self employed person the income evaluated is line 22 of his most recent year's form 1040. In your situation that is the 2011 tax return. The extension reason won't be good enough. For immigration purposes it needs to be completed as soon as possible.

His personal federal tax return is the one that is needed, not the business.

For a self employed person the income evaluated is line 22 of his most recent year's form 1040. In your situation that is the 2011 tax return. The extension reason won't be good enough. For immigration purposes it needs to be completed as soon as possible.

His personal federal tax return is the one that is needed, not the business.

My husband's most recent Federal taxes are OK, his second one is NOT and his third one is OK. Can my mother be my co-sponsor even if she does not live with us? She is an American citizen living in the US.

The other thing is:

On the I-864 form:

Part 1. My husband is letter "e", I am the first joint sponsor ?

my mother would be letter "e", the second of two joint sponsor. ?

Part 5. Sponsor's household size:

1. Your Household Size - DO NOT COUNT ANYONE TWICE Persons you are sponsoring in this affidavit:

a. Enter the number you entered on line 10. 01

Persons NOT sponsored in this affidavit:

b. Yourself. 01

c. If you are currently married, enter "1" for your spouse. (SHOULD HE ENTER 1 FOR ME? THEN HE IS COUNTING ME TWICE)

d. If you have dependent children, enter the number here. 02 (WE HAVE 2 CHILDREN)

Which for does my mother need to fill out being my co sponsor? The I-864a? Who is the household member?

Your mother can cosponsor even if she lives in another house but if you made enough money in the most recent tax year and still do then you don't need a cosponsor.

Include some recent paystubs as well as a letter from his employer stating he is employed with the company and his salary along with the 2011 tax return, if possible. This should prove that he is still making enough money and keep you from getting an RFE. :)

Oops, missed that he was self-employed! Even so, she should most likely be fine if he made an adequate amount of money in 2011.

You can use assets that can be quickly converted to cash as well. There are some restrictions, meaning you can't use the primary family car but you could count extra cars, etc.
