I am so confused about I-864 FORM

Hello all

My wife (Us Citizen) filed a petition for her Monther (my in-law). We recieved NOA#2 last week. I called NVC last friday and they have not received the file from USCIS yet and thus no nvc case# at the moment. Before NVC assigns a case number, I want to get all neccessary documents ready to speed up the process

My wife is currently a housewife and does not have any income. I will be the "sole sponspor" in this case. Does my wife and I both need to fill out two seperate 864s ? or Do I need to fill out I864A since I am considered a household member ? Please kindly advise

if she doesnt have any income then she doesnt fill it out but if she is sponsoring your mother inlaw then she has to fill it out and you would be the joint sponsor. when it ask about household members you include her and when it ask about your spouse you include her.

this is my understand but with that being said i could be wrong

Your wife definitely has to file an I-864, whether she's making income or not. The petitioner HAS to.

As for you, the petitioner's spouse, you'll be a joint sponsor and you can either fill out either the I-864 or I-864A.

You're wrong.

The petitioner must file an I-864. It doesn't matter if the petitioner has no income; the petitioner must always file an I-864. She would only declare her income. If her separate income is zero, then she list zero.

The husband can file an I-864a as a household member. He list his income.
