Your post seems to indicate you have a valid B2 and have been admitted last January (and married last year). It also seems that upon asked (in Jan), you'd mentioned work as the reason for short visit. Did they ask you if you were visiting someone, or who you were staying with? If you are married and visiting wife, you want to be careful about how you answer questions at the entry point.

In terms of immigration, a CR1 will take about 1 year. so if you start now, you have several months to clear family issues.

There is no deportation at the entry point, just the possibility of admission being denied. Since you have been at least a couple of times (from your post), the average inspector would not think that you are intending to stay; but again, watch out how you answer questions.

OK so you are worried about being denied entry. It is very possible. The MOST important thing is that you DO NOT lie to CBP on entry. You'll have tell them that you are visiting your wife. Tell them you are aware of the requirements for the CR/IR-1 and for various reasons you are not immigrating at this time.

One more thing...DO NOT LIE about the reason you are visiting.

Good luck!

Totally agree with the replies. Never never lie.

Tell them the truth.

I got married in Costa Rica, and at that time I had my visa B2. My husband and I were living in Costa Rica. We traveled to the US to visit his family. At the port of entry, they sent us to a waiting room. Nobody talked to us, but they were watching our reaction and body language... anyway, after 20 minutes, we were called by an officer and he asked me a lot of questions. He did not let my husband talk. When he was convinced I was not going to stay, he was very friendly and let us leave.

I was completely honest, I did not lie.

Before I traveled, I asked my boss to write a letter for me, indicating the time I had worked for him, and my vacation time. That letter was very helpful.

The second time I traveled to the States, I went by myself because my husband was already in the US and I could not travel with him because of my job... the thing is that the officer was very rude and again, she sent me to a waiting room, they checked my suitcases, and asked a lot of questions. One of the officers was going to send me back to CR, the other one believed me, and let me go.

I am telling you this, so you can be prepared. Be ready, tell the truth, stay calmed.

Good luck with that!

Bring proof of strong ties to home (lease / home ownership, employer letter stating vacation time & expected return date, university enrollment, etc.) with you on your trip to show to the CBP agent at the US port of entry.
