Filing I-864 AOS before April 15, 2012

Hi all, you guys did a great job of helping out with my wife's petition last year, but now I am working on my Stepson's petition and ready to submit an Affidavit of Support. My question is can I use the last 3 years of Income Tax Form 1040 and Tax Return Transcript for the year 2008, 2009 and 2010 or do I have to wait till the 2011 tax return gets processed to file the AOS for my Stepson? :help:

I just wanted to make sure about this step as the AOS with 2010, 2009 and 2008 are ready to go and April 15, 2012 is approaching. Thank you again in advance for your reply and any input regarding this matter. Have a nice day! :thumbs:

08/18/11 Priority date and Notice date 8/19/11

03/06/12 Received NOA2 Approval Notice Unmarried child (under age 21)

03/28/12 Received NVC Case# IIN# (via email) & emailed DS-3032 from Son in PI.

04/01/12 AOS Fee Paid Online (status Paid on 4/6)

04/xx/12 IV Fee Bill Paid Online (status Paid on 4/xx and printed Barcoded Coversheets)

04/xx/12 Express mail both the I-864s AOS and IV DS-230

04/xx/12 Case completed file shipped to USEmanila: arrived 5/xx/12

05/xx/12 Scheduled Medical/Interview for 05/xx/12

06/xx/12 Visa approved but delivered on 06/xx/12.

06/30/12 POE – Detroit (hoping for 4th of July celebration!)

09/06/07: Went to the Philippines to marry my fiancee.

11/29/07: Wedding Day!

11/30/10: Going back to US, to get my wife!

05-06/11: Sent & Received Congressman's letter & advice.

06/23/11: Found and joined... VisaJourney.com!

06/27/11: Filing “Form I-130 IR-1” and Expediting it with Humanitarian cover letter.

07/08/11: Mailed I-130 to P.O. Box 804525, Attn. EXPEDITE I-130 SPOUSE, Chicago, IL.

07/18/11: Received Hardcopy Form I-797C or NOA1 in mail, receipt date 7/13/11 and priority date 7/12/11.

08/08/11: Called USCIS 800 number to check on status.

08/23/11: Request for Expedite Approved. Received NOA2 dated 08/23/11.

09/09/11: Called NVC they got my file from USCIS.

09/13/11: Received NVC Case# & IIN# (via email) & emailed DS-3032 from PI to NVC.

09/14/11: AOS Fee Paid Online (status PAID on 9/15 also at this time IV Fee Bill Generated)

09/16/11: IV Fee Bill Paid Online (status PAID on 9/19 and printed Barcoded Coversheets)

09/20/11: Express mail both the I-864s AOS and IV DS-230 (arrived 9/21 NVC)

09/27/11: Case completed file shipped to USEManila; arrived 10/3

10/13/11: Medical passed/completed today but still NO interview date yet?

10/16/11: Called USEManila file ready! Called Appt. Services set up Interview Date for 11/9/11.

11/09/11: Interview. But had to comply with 221g, re-verification forms CENOMAR/NBI.

12/02/11: Visa approved but delivered 12/7/11.

12/12/11: POE – Detroit.

First off, the tax deadline is April 17th this year, not the 15th.

Since the tax deadline hasn't passed yet, you don't necessarily have to send in 2011 tax information. You will have to bring it to the interview of course as it will be after April 17th at that point. I would suggest writing a paragraph on your cover letter mentioning you sent the AOS package before the tax deadline of April 17th and will bring 2011 tax information with you to the interview.

That is what I had to do for my case last year. We got to NVC in February. My husband hadn't filed his 2010 taxes yet, so we just sent in tax information for 2007, 2008, and 2009. Then, for the interview, since it was after the tax deadline, I brought my husband's 2010 tax transcript and gave it in.

As soon as your tax return gets processed, I'd suggest ordering the 2011 tax transcript.

NVC should be getting to your AOS package this week. Good luck on its approval!

And there are a lot of people waiting for the IV bill to be invoiced. NVC put on hold all IV invoices until April 13th when the new fees were being implemented. But as of yet, NVC hasn't released the invoices. Hopefully, it's soon!
