I am a bit nervous that our NOA2 will expire before our interview is scheduled. The Trinidad embassy is currently sheduling interviews 8 weeks out, and expecting to only get busier. Our NOA2 just reached the NVC and won't go out for another week or 2 I am sure. With the Christmas rush and upcoming holidays, I am nervous. So in a case where that may occur .... what happens? Has anyone here had this happen to them?

Gina, you don't even have to call, it's automatically extended by the Consulate. The VO has the authority to extend your visa.

There is nothing particularly out of the ordinary with your circumstance. There are Consulates in the world where it routinely takes up to 6 months just to get an interview. So in those countries, it's par for the course and almost all K1 approved petitions are extended automatically.

The embassy will automatically extend the date without any calls to them so do not worry Sir Lancelot is correct that they do this all the time.

Think of it this way, how many petitions make it to the interview before the expire?

You will be fine.

Gina & Johann,

9 FAM 41.81 (Fiance(e)s) Notes, N6.1

It happens all the time. Respond to the visa application package (Packet 3) within a reasonable period of time after it is received and there should be no problem.

Consular officers can extend the approval date for the K-1 petition. In my case, the NOA2, which was originally approved March 31, technically expired July 31. This petition was recalled from the embassy in Paris, and then went to CSC who apparently reaffirmed it without benefit of issuing a new NOA2. At any rate, my fiance had his interview in Paris last week and the visa was approved, so I guess it didn't matter too much that the original NOA2 had expired. BTW, neither did they ask him to see any evidence of a continuing relationship, just needed a handwritten updated letter of intent to from me (the USC). Go Figure, eh? I think this whole process is about 50% predictable, 25% variable based on different embassy idiosyncracies, and about 25% ####### shoot :P But I wouldn't sweat too much about the expired NOA2.

2/28/06 - K-1 app sent to NSC

3/06/06 - NOA 1

3/31/06 - NOA 2

4/12/06 - NVC sent approved petition to Paris embassy

4/24/06 - fiance received instruction pkt (pkt 3)

5/05/06 - pkt 3 checklist returned to embassy

6/16/06 - CRIS-USCIS email "petition received"

6/21/06 - 1-797s (2) received, petition "received", "reopened" by CSC

6/26/06 - email, RFE sent

7/05/06 - RFE received and sent back to CSC

7/06/06 - RFE received, signed for by receptionist at CSC

7/11/06 - email RFE received by CSC
