Please advice Canadian wife in US received Affidavit of support processing fee?

Hi,

I am a US Permanent resident, and I had applied for my wife it has been couple of years now and I received a mail that contains some documents regarding AOS fees etc.

There is a second letter that indicates that if the applicant intends to adjust status with the US Citizenship and Immigration Services please contact NVC before making payment or taking further action.

I unknowingly have already submitted the payment...

My wife is here on a Visit ... what should I do ?

December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Is her PD current? She can only adjust if her PD is current.

If you have already paid the immigration visa fee (DS-230), then you will forfeit it if she adjust in the US.

well, if you have an AOS fee bill , her PD is current.

and NVC is gearing up to start processing for her, as a visa number is available (they don't do this until a visa number is available)

so

I'd take the lesser, cheaper road,

and forget she's in the USA, not try to file any Adjustment of status,

and instead, continue with NVC document intake, paying fees at NVC.

She'll have an interview at that IV unit abroad no later than October, surely, if you get busy today.

Since she's here, go forth with the DS-230, have her fill it out. She may need her civil documents from that 'home country', though.

Ryan I have the DS3032 .. I didn't have a DS 230 in these files though.

I only paid the $88 AOS through website.

That was one of the reasons I rushed to do the payment etc . You are right if it is going to take few months I rather have her go through NVC as I don't want her visit here to be any longer as she m

She might fall out of status.

Meanwhile eventhough I have not received the DS230 should I still have her file it?

My apologies - I just saw yer filing with a canadien beneficiary.

There's an electronic procesing path to do, for canada

PLEASE find Saylin's wiki page here, study all on 'how to do EP for Canada at NVC' , soonish.

there's other forms involved, but the payment stream is the same at the payment portal.

Understood, I have already signed up for the online communication through their website. .. my payment was rejected I sent again and it shows as in process. Following their links on the page I came across the AOS page where I had to choose few options... One of them was form I-864EZ ...

the conditions to fill this form was ..

a. If I was the petitioner of the family members sponsored.

b. I am using only my own earned or retirement income, which is documented using IRS form W2.

c. The sponsored immigrant is the only person immigrating based on the underlying visa petition.

My answer to all above is yes.

When should I send the form DS230 now or once the payment is sent?

Please advice.
