Hi there everyone,

I'm new to the board so I hope you can give me some advice or point me towards some informative threads that might already exist. I met my boyfriend when I was living abroad in Peru for 2 1/2 years and we are getting pretty serious. Instead of jumping straight to applying for the K1 to have him come here i was looking at the F1 so he could study at an english language institute in my home state and we could have some time seeing how we work stateside in a relationship. I am planning to financially sponsor him for the F1 and his studies. My question is....is it possible for us to apply for an adjustment of status if we get married while he is here on the F1?? How long would we need to wait to apply for aos so as to not have the marriage be considered a fraud??? Is it even a real option to change an F1 to a spouse? The F1 is a great chance for him to learn some english and see how we function in the US before jumping the marriage gun to be together, but we may end up wanting to get married if it goes well. whats a reasonable timeline on that?? Is it less complicated to just go the K1 route? Im just very worried about USCIS thinking we are only doing this to bypass the K1 route or something since we clearly already have a relationship (with me financially sponsoring his studies etc)....please any advice???

thanks very much!

It is clearly marriage fraud when you intend to help him here on F1 then AOS.

To get the F1 he will have to prove that he will return to his home country. That might be difficult to do when that is not your plan.
