Update on W-7 rejection

Hello,

Just an update and some words of precaution to those wanting to file Married filing Jointly.

I stated in my thread before that I never received the rejection letter from the ITIN department. I went to the IRS on 03/19 after I found out it was rejected, and they gave their approval and sent it off again. On 03/26, the application was rejected again, even though it was the IRS sending it in. I found this out today, and the reason it was rejected was because person submitting is not qualified to do so(even though it was an IRS agent) and the fact that I didn't respond to the original rejection letter sent on 02/27. Come to find out that the reason I never received the letter was because it was sent to the address on the w-7 application. My wife's Dominican republic's address *sigh* Of course everyone know's how the mail system works there so there's no need going into it. My advice for people going this route in the future is if you want to be sure it will get done, drop everything off at the IRS and forget about "Acceptance agents" because the one I went to(Jean Barnell dumel) in no longer certified to be one, even though he was still listed on the dam IRS website. Learn from my mistake and save yourself some major headache.

P.S I went by the IRS offices today and looks like I will have to file Married filing seperately because of all this and amend when she's here.

When did you submit the first ITIN request? The ITIN hotline won't even let me wait on hold to check on the status of our W-7 because there are so many people calling them.

I submitted it back on feb 8. It would've been done, but the acceptance agent's EIN number expired and they wouldn't accept it from him. However, they didnt' remove him from the site.

Oh no! Sorry to hear that. You still have until the 15th of April to re-submit it. Can you just mail it out to them in Austin, instead of going through agents? I don't understand why they rejected from the IRS Local Office? Are they sending it to the Austin address? Did they include the copy of your wife's passport copy? That's strange. If I were you I will give it another try and mail everything myself to the Austin address. Good Luck!

I would also advise that if the USC spouse will be calling IRS to check on the status of the W-7 application, the spouse MUST be authorized to do it. So, type the name of the USC spouse on the "DELEGATE" line and check the box "power of attorney" - then write wife/husband, otherwise IRS will NOT give any information. I was told this yesterday by one of the IRS operators. I called a few times without getting any info due to "privacy policies". Luckily, I got the number yesterday in the mail.

I think it was rejected again, because the original certificate of accuracy from the original acceptance agent was accidently included. I spoke with the ITIN department(number that i have from here) and they said to send the information back with the letter. I explained to her several times, I WON'T GET THE LETTER BECAUSE IT'S BEEN SENT TO DOMINICAN REPUBLIC. They stated they have no way of getting in contact with the dept because theres no direct number and i should sent them a letter and the entire package again. I said ok, but this time i'm going straight to the IRS.

P.S, I never checked the delegate box. When I call I just say i'm the husband and they ask me personal questions about her and me to prove i am who i said I am.

FINALLY got through on that hotline and they said ours was issued just a week and a half ago, so that's somewhat within normal mailing time from the US to Canada. I didn't check the delegate box either, but the IRS was willing to talk to me because I knew my husband's DOB and address and my own SSN.

I'm glad it worked out for you. I went back to check my forms again to see if I missed anything. Well, looking over the w-7, I saw that for mailing address I put her D.R. address and for residential I put "same". That explains that. As far as why it was rejected again, on the bottom of the W-7 where it says acceptance agent's signature, it still has the old signature of the other acceptance agent, even though the IRS resubmitted it for me. Now, at least i know what's going on. I need to resubmitted another W-7.

My wife also applied for W-7, but got rejected.

Make the store short; I filled W-7 on the behalf of my wife dated Jan 27, 2012. It was done my Certified Public Accountant (CPA). But I was not told to submit my wife's notarized copy of passport.

So, I got notice CP566 on Feb 26th 2012 (issued on Feb 20th) to provide additional document (passport or other two government issued identification documents) with due date April 5, 2012. I mailed the asked documents on March 2.

But got notice CP567 on March 25th (issued on March 21st 2012) stating application for ITIN (Form W-7) have rejected because I did not provide the additional information that they requested when they sent me Notice CP566.

I know I sent the additional documents on March 2, 2012. Even the mail was lost, how could they come with such excuse as the due date is not over.

I am thinking to fill my tax return as married filling separately and do amending tax returns ( Form 1040X) when my wife arrives here. Any suggestion......????

Did you submit your wife's passport through an acceptance agent or just with a regular notary stamp? According to the notary I went to first, notaries in some states do not have the power to certify the legitimacy of the document and therefore cannot help you submit documents for a W-7.

Filing separately and then amending should work if you are unable to get an ITIN for her.

Filing separately and then amending should work if you are unable to get an ITIN for her.

I submitted a copy of Notarized by a foreign notary with an Apostille as instructed on notice CP566 ( first notice issued on Feb 20th, 2012)...

half hour ago, I talked with IRS. She was also suprised to get 2nd notice before due date. but she could not disclose the detail as it's ( W-7) for my wife until my spouse give me power of attorney. good thing is I will have 3 years of the due date of the original return ( without regard to extentions) to submit Amending tax returns ( Form 1040X)....So, It looks like its better to file my tax returns as married filling seperate for now and get ready for my AOS....

But the women said that because i already sent in a "married filing Jointly" I cannot file "Married filing seperately". It can only be done the other way around. I am hoping that I do not have the same problems you are. We got married on Dec 8th. I filed married joint return - I went armed with my completed 1040 income taxes form and W7 forms etc. and on the day my hubby had his biometrics we both stopped into the IRS (Buffalo, NY) and submitted the taxes along with the W7 form. She told us it could take between 4 to 8 weeks because of it being income tax season. Actually someone should write a pamphlet about everything that goes along with the visa journey and beyond including incometaxes, social security number, itin, drivers licenses - I think we will be all rather well learned after this process is over.

No, you should be fine. My problem was the acceptance agent's EIN Number expired so he couldn't accept W-7's anymore, meaning his "certificate of Accuracy" he submitted with my application was worthless. That screwed up my whole application, so I have to submit another one without his signature on the bottom. That's why i recommended to people to just go directly to the IRS and forget about acceptance agents. The guy who accepted mine was still on the IRS website when I went to him. Just a heads up to others.
