EAD at POE

Greetings,

Do one get EAD at POE (for K1)? what is the procedure? I kept on seeing messages from people claiming that they got EAD at POE and wondering if that is standard practice or one need to do something to get that?

The only POE that issues any form of EAD is JFK. However you should be aware that if you're entering on K-1, this temp EAD will only be valid for 90 days and will still require you to obtain a Social Security Number before being able to legally accept any employment.

Once the temp EAD expires you are not legally allowed to continue working until you have received your 1 year EAD which is obtained in conjunction with your AOS application.

actually there have been one or two cases on VJ where people got their temp EAD from other airports, (like houston), or got it from their local USCIS office right after arriving (like pittsburgh). call ahead to the immigration office at the airport, and to your local USCIS office to see if its possible. and even if they say no, ask again when you get to the POE. never hurts to try.

but alot of people don't see the use in it because you only have 90 days. minus 2 weeks to wait for your info to come up in the Social Security computer so you can get a card. minus another 2 weeks (maybe more or less) till you physically get the card. minus alot of weeks hunting for a job. and then when it runs out you have to stop work, so you might only be at some temp job for a few weeks.

once your EAD is filed with your AOS petition, you will get a 1 year card anyway, so you really need to decide if its worth it to you. if you have a job lined up (and already have an SS card), then by all means, go for it.
