Does anyone know what happens if I am using a joint sponsor for an AOS, but this person has filed a JOINT tax return (with their spouse)? On Form I-864, we have put my joint sponsor's individual income (Q23), but their tax returns Q25 it shows the joint household income with their spouse. Is this ok? I also have a letter of employment and W-2s stating my joint sponsor's individual income, but I don't want this to be confusing for whoever reads it.

Don't forget to add a relationship between you and the joint sponsor e.g birth certificate if its a parent. I know this does not answer your questions, however this is what I got an RFE for. I also used my mom as a joint sponsor, she filed with dad and they did not say anything regarding it.

The NVC or the Embassy might request an I-864A from your joint sponsors spouse.

How can they require an I-864A from your sponsor's spouse? That then makes them also contractually obligated to pay back the government if the immigrant uses certain benefits.

Just because a person files joint taxes, it does not force a requirement that their spouse also join in supporting an immigrant if they choose to do so.

In this situation, submit their W-2s and only list their individual income.

There is no need to show relationship proof if your sponsor is a normal joint sponsor filling out an I-864 because they don't to have any kind of relationship with you to be a joint sponsor. If they are part of your household and filing an I-864A instead, it might be different.
