How long to stay outside US before entering?

Hello,

I just have a quick question, I hope someone can help me out.

My mom is currently living in Denmark, and I would like for her to come stay with me for a while. Since she is from Denmark she can enter the US using the visa waiver program. I read about it and I know that she is only allowed to stay in the US for 90 days.

Now what I would like to know is, how long does she have to stay outside of the US before she can enter again? Ideally I would have liked for her to stay 6 months at a time.

Can we drive to Canada and then enter again and she would be allowed to stay for another 90 days?

Or should she contact the embassy in Denmark and submit some papers asking for a longer visit duration?

Going to Canada, Mexico, or the Caribbean Islands doesn't reset the 90 days clock. She would basically have to fly to South America or Europe, but then coming back, she could very well be denied at POE for abusing the VWP.

If she wants to stay 6 months, she should apply for a tourist visa with the US embassy in Denmark.

CR1 Visa

USCIS STAGE: 16 days No expedite request but USC residing abroad
NVC STAGE: 19 days from case # to case complete
03/27/12: interview at Paris embassy - APPROVED
04/12/12: POE San Diego

ROC
01/15/14: sent I-751 application

05/14/14: received card production notification by e-mail, approval date 05/13

Naturalization

02/01/24: N-400 submitted online; Biometrics reuse notice received immediately online; "case being actively reviewed" after a couple hours

02/09/24: received NOA1 by mail

02/10/24: received biometrics reuse notice by mail

04/08/24: interview scheduled for 05/14. Received "We have taken an action in your case" email.

05/14/24: approved at interview, same-day oath ceremony in San Francisco 🥳 🇺🇸

 

Passport

06/10/24: application submitted at post office for passport book and card, paid for expedited processing and shipping

06/24/24: received email notification that passport was approved, then shipped with tracking number

06/25/24: passport received

Th others are correct, she could try for a B2 visa. In either case, a good guideline is to spend more time outside the US than inside, so with the waiver, go home for 3 months before coming back. That doesn't mean she won't be let back a week after she leaves, but chances are smaller.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
