Hello,

I don't know how to explaine my situation.

I came to the US on 2002 as Student on F1 Visa , then I left the US with an orden on Nov 2004 since I over stayed my VISA .

I stayed in touch with my girlfriend ( now my Fiance ) she came to visit me like every year since in Spain and in Morocco, and now she is comming to visit me again the april in Barcelona Spain.

we are both tired of the long distance relationship.

We wanna file for a K1 visa so we can get married in the US.

She now lives in Baltimore , MD

Just we want some help so we can be on the right path.

So we should to file for the K-1 ( NOA1 wait until NOA2 ) then file for a waiver .

If any could help or passed throo the same experience please sahre the informations you have .

and thanks in advance for taking time to read my situation and for the answers that you will provide

Ok first, were you 'ordered' to leave? (you said orden in the post, was that a typo?)

If you were ordered to leave, can you explain that situation for us?

You file for a waiver when and only when (if and only if) the visa is refused by the CONSULATE.

Thanks for the replies ,

as to answer the first answer made by the Canadian wife , well I was out of status while waiting for a new I-20 from FMU ( florida metropolitan univercity ) when I got that documenet ready it was already late and I've been already ober 180 days on illegal status in The us when I went to file for adjustment of status they told me that I over satyed my visa and that repoval order has been pronunced or something like that so to not face problems I left the US within a week
