Make sure there is no waiting period after divorce before remarriage in her state. In some states you cannot get married for 6 months after your divorce is final, so you could not send in the K-1 until then. A divorce followed by an immediate engagement will add scrutiny to you relationship.

I check there is no waiting period after divorce in california. Course after filing divorce have to wait 6 months for the divorce to finalize. My question is , can the letter and cards and messages we send each other after filing divorce but before finalize, used as proof of our relationship? she move out since november, we chat everyday, she will come here after she get her final divorce paper, and only engage here in taiwan , and wait for the K1 to pass then we will really get marry in the state. that will be another 6 to 8 months pass, so that's not getting marry right away.

Again, I am pretty sure that you can use all of your communications both prior to the divorce and after the divorce as proof of the relationship. There may be additional scrutiny, but they are still evidence of a bona fide relationship--even if she was married at the time. The bigger risk, in my opinion, is if her ex-husband gets access to these documents and then uses them as evidence of infidelity and seeks to reduce his level of support or requests support from her based on these documents. I am NOT a divorce attorney, but I see that as a risk.
