90 Days Up for the EAD

Hi Guys - I know that we are not the only ones in this situation as I have read it several times on this board. I am just wondering if anyone has found out what we (meaning those of us who have surpassed the 90 days for an interim EAD and can't go get one because of the new regualtions) can do? I've asked my congressmen to do a congressional inquiry, and have tried to call USCIS with no luck. We're now approaching day 120 with no EAD...... Anyone try anything that worked? Have any ideas? Should be make another Infopass?

I called USCIS today and asked how long it will take to get an EAD ( I am just getting all the forms ready to file). They said that if I don't get approved in 3 months to call for an Infopass appointment and that they will issue me work authorization.

AOS TIMELINE

10/27/06 Mailed I-485 and I765 to Chicago

11/07/06 Checks cashed

11/09/06 Received NOA1 for both EAD and AOS in the mail

11/13/06 Received a letter for Biometrics appointment

11/15/06 Received e-mail that RFE has been mailed yesterday

11/21/06 Biometrics appointment

12/04/06 Sent RFE back

12/08/06 RFE accepted in Lee's Summit - USPS confirmation

12/12/06 RFE recorded on file by USCIS

12/13/06 Touched

12/18/06 Touched again

12/26/06 Received Interview letter dated Dec 19

01/20/07 EAD file touched

01/24/07 EAD approved and card production ordered - received 3 e-mails!

01/24/07 AOS file touched

01/26/07 EAD touched, 3 e-mails received that the approval notice has been mailed

I went for an INFOPASS interview today to see what was taking my EAD so long (application received June 8). The woman told me that the I-765 had been approved and that they mailed me a card Sept. 28. Great, but too good to be true?

I asked if she might be looking at my I-131 application for travel by mistake - which I got email notice of approval Sept 28 - as the receipt number is 1 digit off. Could she double check.

To which she replied "I'm looking right at it on the screen - a card's been mailed to you, good for 1 year."

When I got home I checked the status on line - no approval. I then called USCIS, waited on hold for an eternity, and was told that "No, my EAD was not approved yet." and "The immigration officer you saw was probably looking at your I-131 application case status by mistake."

They did agree that it was over due and would look into it. I got a receipt # and more waiting I guess.

What a waste of a day.

The USCIS officer who you spoke with at the InfoPass appointment may indeed have been looking at the wrong application, but do realize that the USCIS NCSC person is looking at the same Online Status info that you look at. They do not have access to the information that the USCIS people in the field offices have. (Unless, perhaps, there was more involved with the phone call to the NCSC than you revealed in your post.)

Yes, I now realize that they view the same info. However, had the officer been looking at the correct application, she could have initiated an inquiry at least. This is what I did on the phone when I got home.

My case status was touched yesterday after the phone call.

My EAD WAS APPROVED TODAY! Hurray! - just got 5 email

My advice to those who have overdue EADs is to wait it out on hold and speak to an agent.

This also may just be a coincidence ..

How do you get to speak to an agent? Everytime I have called the Customer Service line all I get is a computer recording.

In the telephone menu - I went through to the option where you have an approved application but you haven't recieved anything in the mail or something like that. There were a number of opportunities to speak to an agent I recall. You'll have to wait on hold.

-Technically my application was not approved, but I was told otherwise at the infopass, so I just went with it. The agent on the phone agreed I was way past my date , took my info, initiated an inquiry, and gave me a receipt # - said it could take up o 30 days. It took 1.

My biometrics were delayed 38 days, and so was my EAD (received @ 128 days). So this may be normal actually. The phone call and approval may just be coincidence after all.

I thought I read somewhere if you make an infopass appointment about EAD after 90 days that they give it to you on the spot? Am I dreaming?

Sarah- That use to be procedure but as of Sept. 1 local service centers are no longer issuing the EAD's....hence the frustration!

So I called USCIS and the lady was actually pretty nice (surprisingly). She told me that the St.Paul office should have issued the interim work permit no problem. Arghhh! She recommended making another appointment to go in - and she also sent in a request to find out what was happening and we should be getting a letter regarding our case within the next month. So it looks like I need to try to make an Infopass appointment this morning and try again....I hope it works.

Ya I am pretty sure that one department doesn't talk to the other department ... Hence the nickname the misinformation line ...

I did tell the woman at USCIS what they told us in St. Paul (about no longer issuing the interim EAD's) she told me that she had no record of that. She said she flagged our file so that when we went back they would know we had talked to her. She also sent in a request to find out what was happening with the rest of our applications (green card and AP) and that they will send us all of the findings in the mail in the near future - if we don't get something in 30 days then call again (please God noooO!) We are going to St. Paul next Wednesday - I wish there was a number I could call just to make sure before we drive the 2 hrs there. I really would hate to get there and be stuck again. Then I really wouldn't know what to do...
