Hi fellow VJ's... here's my Q'

Once I have my AOS my son who is 15 and currently in Manila will becoming to the US on a K2. Once he is in the US how long does his AOS take??? Should we also apply for his EAD ?

His AOS will probably take about as long as yours. He will most likely NOT have an interview but that does not necessarily mean it will be faster. If he wants to work then apply for the EAD with the AOS, it is free, so why not?

His AOS will probably take about as long as yours. He will most likely NOT have an interview but that does not necessarily mean it will be faster. If he wants to work then apply for the EAD with the AOS, it is free, so why not?

since the k-2's AOS is automatic once the K-1's AOS has been approved, the chance of an interview should be nil

By the way if my son would like to finish school in the Philppines and his AOS is still on process

as far I knew that no one can travel outside of US until AOS is on hand, can i apply for a permit in USCIS and be back to US for few months like 6 months?

He can only do the AOS once he has entered the US; he can not do it from outside the US.

Huh, care to ask again, be more clear, what are you talking about....permit?.....be back in the US?

IF you have your green card (AOS complete) when he arrives you can get his AOS fairly quickly with prior planning.

We filed our son's AOS the day after he arrived, took the NOA1 to the local office immediately, did walk in biometrics and requested an expedite and an emergency AP. He had an AP in his hands in 10 days and the green card in about 7 weeks. He MUST be in the USA to file for AOS, you MUST have your AOS completed before he can get his, he cannot leave the US until he has his green card or AP in hand.

BUT that requires

1. Your AOS must be complete

2. Expedite request granted

Our son was enrolled in college and had evidence of that enrollment. IF your son is to study abroad as a US resident, you must be very careful to maintain his US resident status and that can be more difficult with a younger boy. Our son, for example, has a Vermont drivers license, a summer job, he files income tax each year, has a bank account that he uses regularly, has registered for the draft, etc.

When Alla arrived we did her AOS as soon as posible so it was complete before our son arrived. She actually went to his visa interview in Kiev and came back with him. What you are proposing CAN be done, we did it and are doing it, but it requires careful planning from day one. It was also our intent to do this before we even filed the petition so everything was carefully planned accordingly. We also met with the local USCIS office before his arrival to request the expedite and find out from them what our exact course of action should be. The local office was, and has been, very helpful
