*January 25 2006 - I129-F received at CSC

*January 30 2006 - packet returned.....arggggggggg we forgot one signature!!

*January 31 2006 - sent I129-F back to the CSC, hope we did not forget anything else

*February 1 2006 - I129-F received at CSC again

*February 3 2006 - NOA1

*April 20 2006 - NOA2!!!!!

*April 24 2006 - Touched!

*May 15 2006 - NVC received petition today!

*May 17 2006 - Case left NVC today!!

*May 30 2006 - Received Packet 3 from Vancouver!

*May 30 2006 - Faxed back Packet 3!!

Wedding planning is not part of the equation.

My questions are:

What are possible consequences of not marrying within the 90 days and marrying later? What are the chances of permanent residency not being approved, or worse, removal proceedings?

Best solution - go to the courthouse and get married. Plan the nice wedding later and save yourself a LOT more immigration headaches.

And there may be consequences beyond our range of knowledge in the case of eventual marriage as well as the case of eventually deciding to not marry.

I think this is a better answer than the one I was going to give, so I am stealing this answer.

We already applied for the I-131, just in case because of her mothers health issues. Do you know, would she be able to use this I-131 (assuming it's approved), while she is awaiting approval of the I-130 and adjustment of status? I suspect not, because her status was K1 when she applied for it.

Everything gets filed together to the Chicago Lockbox... the I-130 is processed at the same time as the AOS and they are both approved or denided after the AOS interview..

Sorry but I am confused.... you have filed for I-131 but not AOS/I-130 ? or you filed I-131 first then filed for AOS and had to file for I-130 because you did not marry within the 90 days??

We filed the I-131 soon after she arrived here due to the health issues. We have not yet married or filed the I130 or AOS

AOS with K-1 as the basis requires: Marrying the petitioner and doing it within 90 days.

Otherwise, K-1 can not be the basis.

I130 inside the US in this case should be fine. Worst case, the I130 moves to the foreign embassy and a visa is issued there. (Assuming overstay less than 180 days). But in practice, this will be approved in the US.

2004-08-23: Met in Chicago

2005-10-19: K-1 Interview, Moscow (approved)

2007-02-23: Biometrics

2007-04-11: AOS Interview (Approved)
