lots of people on visa journey have wait times exceeded 5 month mark. I for one been waiting for K-3 for 5 months 3 weeks and 1 day now. I have given up on K-3. I think they will approve my I-130 to follow the course for CR-1 spousal visa which is better.

Is it safe to assume your husband filed an I-130 petition for alien relative first? The I-129f Petition for a K-3 visa can only be submitted after receiving the NOA1 from the I-130 petition.

The current processing time for IR-1/CR-1 visas at CSC is about 6 1/2 months. They are officially working petitions received around July 12, 2011. Based on timelines from VJ members they appear to be working petitions around July 19, 2011 or so.

It is my understanding that K-3 visas aren't being issued for the past few years because the processing time for the I-130 petition is taking the same amount of time. The NVC will most likely close your K-3 visa and proceed with the CR-1 visa instead.

I believe the timeline is not a reliable predictor of when someone's case will be evaluated. Most folks I know have receipt dates following mine have been approved. So, I think it depends on the caseload that an officer has and how fast he is finishing the task.

Your petition isn't assigned to a specific case worker when it arrives at the CSC. It sits in a box with other petitions until an officer picks up another box of petitions to work. Check out this Q&A with a former USCIS Adjudicator here:

http://www.visajourney.com/content/adjudicator-q-and-a

There is a VJ member who is collecting his own statistics by checking thousands of case numbers on a weekly basis. He can use this information to determine what dates CSC was working that previous week. That thread can be found here:

http://www.visajourney.com/forums/topic/343684-paisamans-i-130-csc-statistics/

The last update from Paisaman said it appeared the last cluster of approvals came from July 14+.

I agree that the Immigration Timelines on this website can be misleading. They include VJ members who were expedited for any number of reasons.

I have been waiting over 6 months on my I-130 as well. I also filed the I-129F. My wife is from Honduras.

Looking ur timeline, shouldn't the Date be reversed? You should have gotten I-130's NOA1 before I-129F

I-130 NOA1 : 2011-09-13

I-129F NOA1 : 2011-08-25

Tuesday, February 14th will be 5 months since USCIS, California Service Center received our I-130 application. My husband is an Indian citizen, he's currently on a student visa in Sydney, Australia which expires March 15th. We were hoping to have an answer by now from USCIS to avoid the expense of extending his visa in Sydney. At this time, he is still unsure which visa he should apply to extend his stay in Sydney. He decided to apply for temp residency, but he's taken the IELTS twice, both times they have failed him, he has it scheduled to take a third time next week. Should I contact USCIS after Feb 14th to inquire about our pending application? Any advice will do. Thank you and best wishes on your visa journey. :)
