Please help - URGENT - Eligibility for Citizenship from GC

Hi Everyone,

I am married to US citizen and I am on conditional residency and my green card was issued on Dec 4th 2009 under condition basis. We applied for removing conditions on Sept 2011. It looks like its going to take 9 months so I had the I-551 stamping done few days before to do travel. Now I have to go to Singappore to lead a project for 8 months. However I am little concerned about elegibility of citizen in US.

At this given situation I am becoming elegible for citizen on Sept 2012 and if I go out of country on March 2012 and will return to home on May and again will go back for 3 months and will come back in August and apply for citizenship under 3 years category married to citizen.

Will I be eligible for Citizenship on Sept 2012? Please advise.

08/29/2009 --- Package delivered at Chicago 2.16 PM.

08/31/2009 --- Checks are cashed today.

08/31/2009 --- Received NOA for I-130,I-131, I-485&I-765 (Notice date : 08/29/09)

09/03/2009 --- Received Biometrics letter appt dt. 09/25/2009.

09/04/2009 --- Walk-in biometrics done today. Everything went off well in 30 mins.

09/15/2009 --- Received RFE for NABC

09/18/2009 --- Responded to RFE

09/25/2009 --- Case resumed.

10/04/2009 --- EAD Card Production Ordered

10/12/2009 --- I-131 Advance Parole approved notice and EAD Received

10/19/2009 --- Interview Letter Received for November 19th 2009 at 7.30 AM

11/18/2009 --- Interview Done

11/18/2009 --- I - 485 Touched and I-130 Touched.

12/04/2009 --- Card Production Ordered.

12/17/2009 --- Green Card Arrived and Welcome letter received.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

no you cant be a US Citizen because you are leaving the country for over 6 months which violates the continuios requirement which is needed for applying for US Citizenship. You can try to apply for waivers and things like that but your case is considered an extreme situation. you will have to wait until you meet this requirement.

Sept 10th 2007 - Sent N400 For Naturalization

Sept 15th 2007 - Meet Fiancee online

December 18th 2007 - Left for india to see fiancee

Jan 1st 2008 - Engaged!!!!!!

Jan 15th 2008 - Biometrics Fingerprinted

May 20th 2008 - Naturalized Citizen

May 30th 2008 - Sent I129 F

June 4th 2008 - NOA 1 Received

July 3rd 2008 - Touched

September 6th 2008 - Left for France.

September 23rd 2008 - NOA2 Received

September 27th 2008 - Will leave for Malaysia from paris.

September 28th 2008 - Will meet fiance after 261 days!!!!!!!!!!!!

October 18th 2008 - Will return back to the US after spending 3 weeks with fiancee.

Dec 28th 2008 - Fiancee Visa approved

Jan 1st 2009 - Fiancee landed on US Soil

Jan 6th 2009 - Married

Jan 30th 2009 - Filed for AOS

May 31st 2009 - AOS Approved

NOA1 - Received on June 4th 2008

Ok I understand but they mention in the USCIS website that if you stay more than 16 months outside of US within your 3 years of stay being married to USC then you will not be elegible to apply for US citizenship.

But in my case I am just going for job deputation to Singappore for 3 months and I will come back and stay here for few weeks then will go back for another 2 months before applying to USC. So will I be considered abonding the residency? Could you please help me understand?

If you are being sent for work I think that might change things a little bit, but you might want to speak with an expert. Is your company big enough to have a decent HR department? Or even an immigration lawyer you can talk to?

Yes. Thank you. It's Top big 5 consulting co. in the world. They mention it shouldn't be a problem as long as I am paying taxes here and going there on business and returning within 3 months. Let see.

Not a problem as long as you can explain to the interviewing I.O. that your overseas assignment was only a temporary gig from the get-go.
