ITR for Removal of condition

Do i have to include my Income tax return as a requirement on Removal of condition? I have a little confusion about it. When i was working , i file as Married on my W2. But when i brought it to a tax professional, she did it as a single file status, i only noticed it after it was already processed. Am i in trouble or will affect my Removal of condition? It means that i cannot present it as an evidence of our bonified marriage? Thanks..

06/2007 onward - long distance relationship went so well

01/2008 - My husband proposed to get married and I accepted it and planned/scheduled to meet me in person

09/04/2008 - He left the States for me

09/06/2008 - I picked him up on the terminal 2 airport

10/08/2008 - We got married

01/29/2010 - Filed 1-130

04/12/2010 - 1-130 got approved

06/21-22 - Medical examination at St. Luke PASSED!!!

07/01/2010 - Interview PASSED! Love you Lord!!!!![/color][/size]

07/10/2010 - Arrived at AL USA with my husband

(POE- Dallas Forthworth Texas)

07/27/ and 08/03- Got 2 Welcome Letters

08/13/2010 - Got my GC [/size][/color]

04/26/12 - Submitted ROC documents

05/11/12 - Biometrics

12/26/12 - RFE

12/31/12 - Responded to RFE

Timeline

You need to file a 1040X to amend the incorrect tax return. I would take it back to the person who did it, point out the error and ask them to file amended return with you as married (you were married that tax year correct?). What filing status did your spouse use?

Yes , i am married until now. On my W2 i am married. After 1 year, i brought it to do my Income tax return to a tax professional, and she filed me as single status. I don't know what is the difference between married on W2 and single filing status on my 1040A. My husband is not required to file taxes because he is receiving from SS disability and cant work because disabled. When i asked her why she filed it as single filing status, she said its just the same thing married filing separately and single. I wanted it as married filing separately. Do i still have to file a1040x amended?

Yes you need to file 1040X amended.

Thank you. So i will have to amend the 2010 income tax return correction from single to married filing separately. How about for my income tax return 2011 that i will file tomorrow monday? Can i put married filing separately since i will just correct the last year filing status?
