How old is your sister? Is she married?

Posted

My sister will be 20 of this year 2012 and no kids and no she's not married. My mother first filed the papers back in October 18, 2010 and got approve by NVC in Aug. 2011. So could it be this year or next year she will get to come in the USA.

If you had referred to the link that was posted for you,(Visa Bullentin) it looks to be 2 years or more. You will need to keep referring to the monthly Visa Bullentins. They are updated every month. This information is public knowledge.

Okay, you need to give specific dates on the following;

Your sister's birthday (month/day/year): ?

Petition date: Oct. 18, 2010

Approval date: ?

The current PD in the F2a category (LPR petitioning an unmarried child under 21) is June 8, 2009. This mean it will likely be a year to a year and a half before your sister's PD becomes current in the F2a category. If her PD is not current before her 21st birthday, she will age out into the F2b category (LPR petitioning an unmarried child over 21). This changes her wait to 8 years because the current PD in the F2b category is October 15, 2003.

Without the specific dates, no one can tell you if your sister will be here next year or if she has to wait longer. There is no way she will be here in 2012 unless the PD dramatically jumps in the F2a category.

My sister date of birth is June 25 1992. Petition date October 18, 2010 Approve by NVC August 5 2011

It took USCIS about 9 months and 17 days to approve the I-130. For CSPA, this time is not held against your sister in calculating her age.

Your sister will turn 21 years old on June 25, 2013. Because of CSPA, she gets an extra 9 months and 17 days. As long as her PD is current before April 2014, she will be able to retain her place in the F2a category.

If the PD in the F2a category moves month for month (there is no guarantee of this - it could be faster or slower - no one can tell you how the PD will move), your sister's PD will probably be current in another 16 months (the difference between her PD and the current PD in the Visa Bulletin).

Your mom should expect to receive the IV and AOS fee letter in the last few months of this year. Your sister will probably get her interview sometime in the summer of 2013. You can expect her to be here shortly after that if everything goes smoothly.

Thanks very much for all the information, but when my mom filed the I-130 in October 18 2010 it only took 3 months because she got an approved e-mail in February 9 2011 and the NVC got everything and we paid all fees and got approved by the NVC in August 5 2011. They told her she might not have to wait another year, but they might be lying to me anyways thanks again

She could possibly be here by the end of the year I am F2A from Jamaica and I have received the fee bills from NVC so we could see some advancement in the Priority dates close to year end just keep watching the visa bulletin. My prority date is October 12, 2010
