Hi VJ members,

Just want to decrease my anxiety level by relating to someone who's had a similar experience as us. My k1 petition has actually been processed without any impediments untill the actual interview done in December 2011. My fiance was not granted a visa on spot, but was told that they will be in contact with me because they needed more "evidence to substantiate our relationship." In other words they have reason to believe that our relationship might be FAKE. This was a big blow to myself and my fiance, because we thought all was well and we had already started planning our wedding.I was devastated when I got the terrible news from my fiance. I have e-mailed the consulate on several occasion but to no avail, I have yet to hear of a visa approval. Last time I checked the Vermont Service Center, they did not receive the petition from the Jamaican Embassy. :(:(

First course of action is to provide the US Embassy in the foreign country all the supporting evidence and make sure they receive it. Have you done that yet?

Your fiance was put on administrative processing review. This means the embassy is waiting for you and your fiancee to send them additional proof of your relationship.

You need to send them

-Photos of you two together and with family members

-Airplane tickets to visit him (vice versa)

-Skype chat logs

-Email logs

I would HIGHLY recommend you send the requested information to them soon, because the embassy will not provide an update or answer until they receive that information. Also, it does no good contact Vermont Service Center, it's beyond their control once it reaches the embassy level. You will need to contact the US State Department and they can provide you updates on the case. You need to give them the Case Number, Name of Beneficiary .

Is this a poll, or a request for information about your case? If it is the the latter, all you can do is wait until they reach out to you.

did you review the scanned document that your fiance emailed to you, that he / she recieved on interview day?

There's a lot of conflicting info/opinion about your next step - based on what you've written in this post.

--ask you for more proofs vs

--casefile sent back vs

--you sending stuff into the Embassy.

but we really can't tell you what the next step will be unless you tell us the contents of that document.

TIA for letting us know the exact content of that document.

Thanks for the advice, however all of the required evidence were submitted with original k1 petition and @ the interview.....pictures, boarding passes, mail correspondence, receipts, etc... As stated previously the Jamaican Embassy claimed that all the documents will be returned to the dept. of USCIS then I will be contacted by them when they are received... I guess now this another long wait...... :crying:

I have seen this happen so many times in the last year :(

I am so sorry you are in this position. I have researched and found many links with info on what can be done at this point.

I will share as much as I can to help. (L)

Hard truth: you are in for a long wait.

180 days is the estimated processing time on 221g refusals... and that is just the time it takes to receive word back from USCIS...

Best case scenario: the VSC sends you a NOIR (notice of intent to revoke) and allows you a certain timeframe (30 days) to respond to the consular's findings and prove the validity of your relationship. If the USCIS officer is convinced that the consular was mistaken, they will re-affirm your petition and send the case back to Kingston for a second interview.

Worst case scenario: you can marry in Jamaica and file again. (F)

But don't marry him yet, your K1 is still alive...

You need to know what exactly the consular was concerned about. You can get the consulars memo to USCIS by filing an FOIA here: http://foia.state.gov/foiareq/foialetter.asp

Contact your congressman, they can also get details from Kingston as to why the consular questioned the validity of your relationship.

Get every detail (if you have not already) from your fiance'. What questions did they ask him and how did he answer??

Use all the information you gather NOW and prepare a response to the NOIR before it comes because even if they let your case expire and you have to file again, you will need to address why the initial petition was not approved. :(

Search the VJ forum and google for 221g refusal and NOIR.

There is plenty of info out there and there is always hope.

Bottom line you are alive, he is alive, and if you both truly love each other you can get through anything. (F)

Be careful in providing info for another consulate, as they tend to do things differently.

Kingston has sent back MANY cases to USCIS for revocation based on relationship validity this year. If they told her the case was being sent back, they are done with it.

The only person I know who was able to get a second interview without having to overcome the NOIR was blessed that she was able to e-mail that very morning and address their concerns and promise to come immediately for a second interview. Everyone else has been told there is nothing more Kingston can do and to wait for USCIS to contact the petitioner.

DO NOT SEND ANYTHING TO KINGSTON AT THIS POINT! (F)

I was in the same situation earlier in 2011. What they want to see if an existing relation ship. Do you have copy of your long distance phone bill showing daily or constant contact with your significant other? Or maybe chat logs, skype logs, emails showing an on going relationship? I had mailed that to them with about 100+ picks this is what they wanted but on top of that all I showed up on the embassy's doorstep inperson this seem to have blown them out of the water.(with all the daily long distance calling logs) got my now husband his visa that same day. :yes: :yes: :yes:
