It is not possible to get both parents and children here at the same time since the visa category does not allow it. There is not a way to bring them here and then have them adjust their status .. maybe in years to come.

IT does NOT take 5 years to reunite a family. Once your mom is here she CAN file the petition for the 9 year old child. The process will take 2-3 years which is 1/2 the time you were expecting. I know that no one is forcing your parents to come here and I hate when some of these hard @ss headed people say that as if it is Not obvious. That is why a case is created, a petition is filed because it is optional.. unnecessary comments i call it.

My mother has came and have filed a visa petition for her son, my brother (F2A). The petition was filed 1 year and 1 month ago and I'm sure that he would be interviewed and be given a visa in about 8-10 months time. The current processing cut off dates for the said category is June 8, 2009 and have been the preference category with the MOST consistent move for years.

If I had to make a suggestion i would file a petition for your MOTHER and when she gets here submit the case for her husband and child which could be processed together. Like my parents and many other who had green cards she can travel for a certain length of time to her country if she wants to be around her family.

There are several flaws in your ideas

The F2A is not eleigible for an immediate visa. After the processing and the interview, the waiting begins, it does not end. THAt is when you begn waiting for a visa number. Your brother may have an interview this year but he will not be issued a visa. I may be wrong and it may be the interview that is delayed until they have the number ready, which could be years.

Also it is not the OPs mother and father that are being petitioned. It is his foreign wife's mother and father. she must first become a citizen whch will take 3 1/2 years minimum, more like ly 4 years. THEn she can petition her parents and brother, another year in processing. The Parents are eligible for an immediate visa number, her brother is not. Her parents will receive a visa in about 1 year, her brother will wait 5-7 years for the visa issuance AFTER the etition is processed.

He will no longer be 9 years old. He will be at least 14 before the parents can get a visa. Closer to 20 before he gets one

OR

The mother can come, as you suggest and petition hewr son but because she is not a citizen her son is not eligible for an immedate visa number and you are back to the same situation

OR

The mother can wait until SHE is a citizen (5-6 years) and then file for her son and wait 1 year but that puts you on about the same timeline either way.

Clearly the OP was under the impression that he could just bundle up all his wife's family once they were married and they could all come along just as she had. That is not correct.

Did not say the visa was ready immediately. The current processing time for the brother will be 2-3 years.(read on above.)

Ricardo has the fastest option & the correct information.

3-4 years - wife gets US citizenship

1 year - US citizen wife files for at least one parent - Immediate Relative

2-3 years - LPR parent files for minor unmarried child - F2-a.

In addition, it does not take 5-7 years for a US citizen to petition for a sibling. This would be an F4 family preference case and it currently takes 11-12 years.

Correct me if I am wrong, someone, but with the F2A the processing time for the petition is 2-3 years and THEN you wait for the visa number. Unlike a CR-1, IR-1, IR-5 or K-1, you do not get a visa issued immediately after processing is complete. There are only a certain number of F2A visas issued in each country each year

If someone can point out where I am wrong on this, please do.

An interview will not be scheduled until the cut off dates arev reached. Once the case is current the NVC will schedule an interview UNLESS the consulate involves are behind schedule. After the interview the applicants will be issued their F2A visas. The only time when visas issuance are delayed will be 1. If the case is placed in AP or 2. Retrogression which most won't want to discuss.

Thanks Richardo and Easyriders, It was good to get some real information and not just peoples assumptions of my intentions. To everyone else, They are legally my family that's why they are called "IN-LAWS" in fact legally is the only way they are my family. I did not force anyone to do anything I was only looking for something I might have missed or some tricks or tips from people who have succeeded. I have no intention of bringing every living person and their pets to America. I thought it would be best for my future child, my wife, and her Mother and Father to be together and to be a close family, sorry if it sounded strange to me to leave a 9 year old boy alone while his parents came to America, guess that's just me trying to use logic in am illogical world.

I think the point being made is that they can be a close family (geographically speaking), it's just going to take some time. If it's a priority for them to be together now, perhaps your wife and you could move back to her home country. That likely would be faster and easier. No one thinks its strange to not want to leave a 9-year-old boy alone, and no one is suggesting that. All that is being said here is that he isn't forced to be alone. His parents can stay in their country with him, or your wife could petition one parent, etc. It's just not going to be a quick process, no matter what.

As others have said, the U.S. cannot absorb the influx of immigrants if every recipient of a spousal visa is allowed to bring parents and siblings over ASAP. It's just not practical, nor is it doable.

You are welcome. Dont move to your wife's country - stay here in America and file the petition that is best for you.
