Hi,

Could somebody help clear this up? I'm a little confused about the medical exam proceedures.I understand a I-693 medical exam form needs to be filed with the I-485 AOS. (We will be filing both a I-130 and I-485 while my spouse is here in the US on a visa waiver.)

Does the medical exam have to be done only in the US? My spouse got a medical exam done in her home country before arriving,was that necessary if we are applying from the US? Can anything in the foreign exam be used for the I-693,or do we need a complete do over? Do we need both exams? How recent does the exam need to be?

If you are filing a concurrent I-130/I-485 application, then your post should be in the "adjustment from work, tourist visa" forum. A mod will move this one over there. The people in this forum have different instructions for the medical so reading and taking advice here may confuse you.

You need to get a full medical exam with a USCIS-designated Civil Surgeon. The people who are mentioning a medical exam in home country are talking about embassy-certified civil surgeons prior to obtaining a fiance visa, not just a trip to their local doctor for a check up. Did your wife go to a embassy-certified doctor for an immigration medical?

The medical exam must be done now with a Civil Surgeon. The doctor will give your spouse form I-693 in a sealed envelope (don't open it!) and you will send that envelope off with your packet.

Again, please don't let what is in this forum confuse you - the process in the "adjustment from family-based visas" is not for you. Good luck.

Were you already married when she entered the country on a visa waiver? Because if that's the case, I don't think you can apply for AOS... someone please correct me if I'm wrong!?

If she entered on a visa waiver and then you decided to get married, with no prior intent of getting married, then yes, you can file I-485 and I-130 and she needs to get a medical done by a civil surgeon that USCIS recognizes (you can find a list of civil surgeons on their website).

If you were already married before she came to the US, she'll have to go back to her home country and you'll have to go through a different process for her to be able to the US and gain permanent residence.

01/11/2012 - hard copies of NOA for I-131, I-765 and I-131 (FINALLY)
01/24/2012 - biometrics letter for I-485 and -I765 in mail, appointment 02/02/2012
01/31/2012 - successful walk-in biometrics
03/06/2012 - EAD and AP approved, card production ordered
03/09/2012 - second notification about EAD card production
03/12/2012 - notifications about EAD being mailed and USPS picking it up
03/14/2012 - EAD/AP combo card in hand, email notification about interview appointment
03/19/2012 - Interview letter in hand, appointment for 4/19 in Denver
04/19/2012 - Interview date: APPROVED!!
04/28/2012 - GREEN CARD in hand! :-)

1/31/2014 - USPS delivery confirmation

2/10/2014 - received biometrics appointment letter for 2/26/14

2/21/2014 - infopass appointment about missing NOA1
