My husband a USC have file his taxes for the last years as head of household.(since i don't work) Is this way that we have filed the Taxes wrong.Am i going to get in trouble with immigration for not filling married since I do have a tax id number. should i amend our taxes and file them as married . ? can someone please help me. thanks

The key is filling your taxes, you should claim the best status so you can to pay less to the government. You can always file an amendment it is free or call the IRS a CPA etc. for information.

It is wrong for your husband to file as head of household if he was married. To file as the head of a household, the taxpayer must be unmarried or "considered unmarried."

Generally, it is better to file a married tax return than file as head of household. An additional person means more deductions which results in less tax owed to the IRS.

It is best if you and your husband amend the returns as married filing jointly for the years that you were married.

Head of Household Filing Status

You can claim the Head of Household (HOH) filing status on your tax return if you are unmarried, have cared for a dependent for over half the year, and paid more than half the cost of maintaining a home.

Taxpayers claiming the Head of Household filing status benefit from a higher standard deduction and lower tax rates compared to the single filing status. The definition of HOH filing status is quite specific, so read over the criteria carefully.

You are unmarried or "considered unmarried" on the last day of the year.

You paid more than half the cost of keeping up a home for the year.

A "qualifying person" lived with you in the home for more than half the year (except for temporary absences, such as school). However, if the "qualifying person" is your dependent parent, he or she does not have to live with you.

Assuming your husband made over $12,000 in taxable income, you will benefit by filing a 1040X (amended return). Up until $12,000, HOH and MFJ are the same. Above this, filing MFJ has a lower tax rate. The tax table for 2011 is below. As an example, if he had $25,010 in taxable income, a HOH pays $3,146 in tax. An MFJ pays $2,904 in tax on the same income. A savings of $242. At $100,000 of taxable income the savings is about $2,500.
