I sent an I-130 petition for my spouse on April of 2012 and I recieved a reciept. Its been 8 and a half months, almost 9, since Ive sent/received it and I havent received a reply. I checked the processing time frame on USCIS.gov for California on I-130s and the time frame was 5 months, which mine is 4 months past. I was wondering can a PENDING I-130 expire? I have tried googling this question but it brings up every uscis form EXCEPT I-130. I have called the NCSC but I didnt know how to get ahold of a customer service agent to speak to and the case update is the same everytime I check, online or by phone. Ive also emailed them about my case being late they told me to fill out a DHS 7001 Form, which I have but all they told me was that they have received my case and they have added it to the system and that I will receive a confirmation email with a case number, AFTER I emailed them that Ive sent it. My second question is how long does it really take to receive a reply for an I-130?

And I am planning on traveling to see my husband in a couple months, we live in Yemen. I do have a 5 month old, and because Yemen is in bad condition at the moment I want to keep my son as safe as possible....I was really hoping that I would have received a reply by now. Is there a way to speed the process?

ok here is how it goes when you want to talk to the customer service line here are the directions:

This is what I'm doing:

1.)Dial the uscis customer service number

2.)To continue in English press 1

3.)To check the status of an application press 2

4.)If you know your receipt number press 1

5.)If your receipt number starts with SRC press 1

6.)The receipt number you entered... if this is correct press 1

Information you heard is most up to date...

7.)report a problem with your case press 3

& you will be connected! make sure you have your case/file number ready.

You have reached the technical service center..

Well I called the number and told them that its out of processing time and did a service request and gave me a reference number and told me I will get a reply back in 15 days. I hope thats a good thing.

Does doing a service request help out in this type of situation??

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)

May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)

when you call back into USCIS hotline,

when you get the first human,

ask for a 2nd human - an ISO, a Tier 2 human

then, once you get an ISO -

inquire for the status of your casefile, ask them to review all on your casefile.

the first person that answers the phone, the CSR, the Tier-1 rep? Can only see what you can see online in the USCIS status portal.

An ISO can see much more...

They will be giving you answer into why its taking soo long.

I just filed one a week ago.

When I did a service request they mailed me back a letter with all the information on it and it said " this case is currently under extensive background check. You should recieve a notice of action within six months." But I checked my case on USCIS.gov and they approved it YYYYYAAAAAAAAAAAAAYYYYYYYYYYYYYYYYYYYYYYYYYYYYYYYY!!! Thank god, after 9 and a half months! When I seen it I was super excited. So I do think the service request does help a little, but I did contact congressman about it and thats how I officially found out until I checked the website to make sure lol. Good luck to you all!! And thanks for your advice!

I just want to know when you checked your case number the USCIS.gov website , what dot is your application process on??

Is it on initial review or another dot? please name what dot?

After I-130 approval, the casefile will move to the NVC.

After exactly 2 weeks from my case approval I found out my case number super YAY!!!! I called in and checked it told me the case number and said to wait 6-8 weeks until they contact the beneficiary. So crossing my fingers! :D
