HI All,

Need a little more advice on the RFE I recieved. Seems basically I am being asked to submit all my information once again to prove our relationship. The one request that concerns me is about intent to marry statements. It says we must both file original statements indicating we plan to marry in 90 days. I sent the originals with my K1 package and now only have copies of them. Would I need to do new intent to marry statements or would copies of the original ones sent be fine?

I personally would do new ones with fresh signatures.

Could it be sent to you in a timely manner?

My fiancee is out of town at the moment with her family so it may take a couple weeks to recieve one from her. I do think its a good idea to add fresh ones. Just was not sure if new dates on them would cause a red flag. I am given plenty of time to respond to the RFE so maybe its better.

I agree. It's better to submit new documents with ORIGINAL signatures.

And as a side note, it's nice to see someone who recives a RFE take the time to submit the evidence properly and not try to rush things by attempting to shortcut the system. It may cost you a couple of additional weeks to receive the NOA-2, but it beats submitting docs with scanned signatures, which could result in an outright denial at USCIS and having to start all over again.

New dates will not be a problem. I would NOT submit copies for TWO reasons

1. They want original signatures

2. I am not assuming they LOST your statements, I am assuming they did not meet the criteria. Why send them copies of something that resulted in an RFE?

VJ has sample letters of intent right here at this site. Check under "sample forms" we used that letter exactly as shown, changed names and dates of course, and had no problems.

Submit new letters.

Another hint: When you sign the new letters, use BLUE ink. I know the instructions say to use "black ink", ignore that, walk on the wild side and use BLUE.

Please note in submitting to the ISCIS and embassy, you need to keep all your ooriginal documents and submit only copies. Because you submitted all of your original documents, you are getting an RFE. This is something which is not common.

When I got my RFE, I took my originals and the copies to the bank. the bank notarized my copies. I then sent my copies to the USCIS, keeping the originals. I would suggest gathering as much data as you can to prove meeting in person in case you need it later on. the good news is getting an RFE means you are very close to the end of your journey at USCIS.

the letter of intent should be an original, not a photocopy. what I did was have my then fiance sign two letters of intent so I'd have an extra one with original signiture.

Page 3, 5B of the instructions directs that the statement of intent to marry be "original"

Original signatures are required for the I-129f and the letter of intent. If you were approved with a copy of the letter if intent, you were lucky. It is not to be advised.
