Hi everyone,

I hope someone can help me out here:

We've been struggling to get my wife her immigration visa for a long time now. Everything seemed to final start moving along smoothly until her interview on October 26. They rejected her application saying that we need a co-sponsor.

I more than meet the sponsorship requirements listed on the USCUS website. When I asked about why I don't qualify, they said that because my salary is from a foreign job which I would be leaving if/when she got her visa, I would have to have a co-sponsor. Is this a legitimate requirement? The only condition I saw for a petitioner living abroad is that they should prove that the overseas living arrangement is temporary - which I have done.

Would a job offer from a US company be sufficient in lieu of a co-sponsor?

(I moved to live with her and our toddler son because she hasn't gotten a visa until date)

Thank you all very much for you help!

This is definitely a legitimate requirement. The Consular Officer is evaluating what the family income will be once you are in the USA. If you won't have a job at that time, your current income means nothing. A job offer is not "current income". Unless you have at least three times the income requirement in "LIQUID" assets, you'll need a joint sponsor who does qualify based on their own family size plus any intending immigrants.

I take it this is a CR1 or IR1 and perhaps CR2 and IR2 visas you are pursuing, not K3.
