Hi All,

I have question about I-130. I made a mistake(honest) and left(did not disclose) one vital information about my wife on I-130.

I already filed my I-130 this month (Dec. 2011). I am wondering how to go about this situation.

I am 100% sure that USCIS and NVC wouldn't find this missing info but I am concern that there is a possibility that at the interview

they may find out that we missed this info from all paper work.

So I have following choices:

#1. Send this info separately to CSC (USCIS)? or

#2. Send another I-130 with the corrected info to CSC (USCIS)? or

#3. Send this corrected info while I am filing for NVC after I-130 approved? (see my related question below)

#4. Don't do anything and wait for interview.

I also have following related question:

When USCIS approve I-130, do they send all info to NVC? I am asking this because for NVC process, we need to send same documents again. Does NVC have a copy of I-130?

Please give me your expert opinions to help me decide.

Thanks.

Of course, NVC has a copy of the entire file. What did you leave out? What was your mistake. Without information, no answer will be useful.

We need more information in order for other VJers to assist you. Once your petition is approved by USCIS, they send the entire packet to NVC. At the NVC stage, you are not going to be submitting the same documents as you did for USCIS.

Good luck.

Hi,

Thanks.

Please be clear. If you didn't mention the beneficiary's previous marriages, then you have potentially submitted a fraudulent petition. What you can or should do about it now depends on why you failed to submit a truthful petition. Did you withhold information you knew, or did your wife withhold it from you? This is not a small "correction". It is a major issue.
